CITY COUNCIL WORK SESSION
September 23, 2019
A work session of the Council of the City of Salem, Virginia, was held in Parlor B,
Salem Civic Center, 1001 Roanoke Boulevard, Salem, Virginia, on September 23, 2019, at
6:30 p.m., there being present the following members of said Council, to wit: Byron
Randolph Foley, William D. Jones, Jane W. Johnson, James A. Martin (absent), and John E.
Saunders; with Byron Randolph Foley, Mayor, presiding; together with James E. Taliaferro,
II, Interim City Manager and Clerk of Council; Rosemarie B. Jordan, Director of Finance;
Beth Rodgers, Human Resources Director; Kristie Chittum, Commissioner of the Revenue;
Crystal L. Williams, Assistant to the City Manager; and Judy Hough, Deputy City Clerk; and
the following business was transacted:
Mayor Foley reported that this date, place, and time had been set in order for the
Council to hold a work session; and
WHEREAS, Ms.Chittum gave Council an update related to proposed Salem City
Code changes for the Commissioner of the Revenue’s office; and
WHEREAS, Ms. Rodgers gave Council an update on the staff retreat and the
leadership team projects; and
WHEREAS, there were no other topics for discussion.
There being no further business to come before the Council, the work session was
adjourned at 7:20 p.m.

A regular meeting of the Council of the City of Salem, Virginia, was called to order
at 7:30 p.m., there being present the following members to wit: Byron Randolph
Foley, Mayor, J ane W. J ohnson, Vice-Mayor, Council members: William D.
J ones, J ames A. Martin (absent), and J ohn E. Saunders; with Byron Randolph

A.Amendment to the Zoning Ordinance
Hold public hearing and consider an ordinance on first reading for rezoning the
properties of R. Fralin C ompanies, Inc, contract purchaser, and T he Simms Family
Limited Partnership and SFE, LLC , property owners, located at 211 Diamond Road
and 135 Diamond Road (Tax Map #s 272-2-1 and 273- 2-1) from A G - Agriculture
District / RSF - Residential Single Family District to RSF Residential Single
Family District. (Continued from the August 26, 2019, meeting. Petitioner has
requested to withdraw the request. Recommend withdrawing the request; see Page 1
Planning C ommission minutes.)
William J ones motioned to acknowledge and approve the request of R. Fralin
C ompanies, Inc., petitioner, to withdraw Item 4A Amendment to the Zoning
Ordinance, Item 4B Special Exception Permit to allow Single Family Dwellings ,
Attached, and Item 5A Special Exception Permit to allow Cluster Housing Overlay
- Single Family Dwellings, Detached. J ane J ohnson seconded the motion.

B.Special Exception P ermit
Hold public hearing to consider the request of R. Fralin Companies, Inc., contract
purchaser, and T he Simms Family Limited Partnership, property owner, for the

with proffered conditions on the property located at 211 Diamond Road (Tax Map #
272 - 2 - 1). (C ontinued from the August 26, 2019, meeting. Petitioner has

A.Special Exception P ermit
Hold public hearing to consider the request of R. Fralin Companies, Inc., contract
purchaser, and T he Simms Family Limited Partnership and SFE, LLC, property
owners for the issuance of a Special Exception Permit to allow C luster Housing
Overlay - Single Family Dwellings, Detached with proffered conditions on the
properties located at 211 Diamond Road (Tax Map # 272-2-1) and 135 Diamond
Road (Tax Map # 237-2-1). (Advertised in the September 5 and 12, 2019, issues of
the Salem Times Register. Petitioner has requested to withdraw the request.
Recommend withdrawing the request; see Page 1 Planning Commission minutes.)
B.Use Not P rov ided F or P ermit
Hold public hearing to consider the request of Hines Services, LLC , dba Farmer
Auctions, lessee, for the issuance of a Use Not Provided For Permit to allow retail
sales and an auction and appraisal business on the property located at 29 Wildwood
Road (Tax Map # 137-1-1.2). (Advertised in the September 5 and 12, 2019, issues
of the Salem Times Register. Recommend approval with conditions; see Page 2
Planning C ommission minutes.)
Mayor Foley stated notice of such hearing had been published in the September 5
and 12, 2019, issues of the Salem Times Register and the Planning C ommission had
recommended approval of the Use Not Provided For Permit with conditions.
Staff noted the following regarding the request: the subject property consists of a
.432-acre parcel located northwest of the intersection of Wildwood Road and West
Main Street. T he parcel is occupied by a 4,200 square foot, one story commercial
building. T he building contains a 1,000 square foot showroom that fronts on
Wildwood Road and includes a 3,200 square foot warehouse in the rear. T his
property may be accessed from both Wildwood Road and Horner Lane. T here are
currently 8 designated parking spaces contained in the approximately .24 acre paved
area. T his property is partially located within the FEMA designated floodway and
the 100 year flood plain. One concern is: how will parking for large events be
handled.
Mr. VanAllman noted this business was previously located on Midland Road. At
that location, the business had a much larger facility, and the owners conducted a lot
of live auctions. Mr. Hines, petitioner, purchased the business a few years ago and
is basically reducing his foot print. But in order to move into this building on
Wildwood Road, he needs to obtain a Use Not Provided For Permit. He noted that
the petitioner was in the audience and could answer any questions they might have.
Also, Planning Commission had concerns regarding traffic and parking and has
recommended approval with conditions.
Mr. J ones asked what were the conditions. Mr. VanAllman noted the conditions
were 1) no more than six live auctions per year and 2) no on-street parking on
Horner Lane. Mr. Yost noted the second condition is actually no on-street parking
whether it be on Horner Lane or Wildwood Road.
Mayor Foley asked if the petitioner would like to speak regarding the request, and
Mr. Hines noted that he did not wish to speak. Mayor Foley opened the public
hearing and asked if anyone would like to speak regarding this request. T here was
no response, and the public hearing was closed.
Mr. J ones noted that he is glad Mr. Hines wants to keep the business in Salem. He
asked Mr. Hines how would they control overflow parking when they do have the
live auctions. Would the customers park across the street at the shopping mall?
Mr. Hines noted that he believes they have enough parking to accommodate the
auctions. He explained that they have a grassy area to the left of the building and
also in the rear. Also, the garage doors on the side of the building they will be able
to park cars in front of those doors during auctions. He further noted they will have
an attendant in the parking lot to prevent cars from parking on Horner Lane and also
to make sure they park in the configuration they want them to. T hey cannot prevent
someone from parking in Angelle's parking lot if they are going to have lunch there
after the auction is over, but they will not encourage them to park in Angelle's
parking lot.
William J ones motioned to approved the request of Hines Services, LLC , dba
Farmer Auctions, lessee, for the issuance of a Use Not Provided For Permit to
allow retail sales and an auction and appraisal business on the property located at
29 Wildwood Road (Tax Map #137-1-1.2) with the following conditions: 1) no more
than six annual live auctions and 2) no on-street parking. J ane J ohnson seconded the

Consider setting date for public hearing in accordance with Section 22.1-29.1 of the
Code of Virginia, 1950 as amended, regarding the expiration of terms for Andy
Raines and Artice Ledbetter. (Suggest date of October 14, 2019)
J ane J ohnson motioned to set a public hearing date of October 14, 2019, to receive
candidates for the expiration of terms for Artice Ledbetter and Andy Raines on the
Salem School Board. J ohn Saunders seconded the motion.

D.Appropriation of F unds
Consider request to appropriate proceeds from the sale of equipment. Audit -
Finance C ommittee
Mr. J ones noted the Audit Finance Committee met this morning to discuss this
request. T he City sells equipment that is no longer used on Gov Deals, which is an
on-line auction established specifically for governments to use to dispose of surplus
equipment. T he old mobile stage was recently sold on Gov Deals. Proceeds of
$31,350 were received and will be used to cover unanticipated maintenance costs at
the Senior Center. T he C ommittee reviewed the request and recommends
appropriating the revenue from the sale of equipment to be used to cover
maintenance costs.
William J ones motioned to approve appropriating funds from the sale of mobile
stage for the Parks and Recreation Department in the amount of $31,350 and moving
to maintenance at the Salem Senior Center. J ane J ohnson seconded the motion.

6.C losed Session
A.Closed Session
Hold a closed session in accordance with the provisions of Section 2.2-
3711A(3) of the 1950 C ode of Virginia, as amended, for a discussion or
consideration of the acquisition of real property for a public purpose, or of the
disposition of publicly held real property, where discussion in an open meeting
would adversely affect the bargaining position or negotiating strategy of the
public body.
Vice Mayor J ohnson motioned to move to closed session at 7:44 p.m. in accordance
with the provisions of Section 2.2-3711A(3) of the 1950 C ode of Virginia, as
amended, for a discussion or consideration of the acquisition of real property for a
public purpose, or of the disposition of publicly held real property, where discussion
in an open meeting would adversely affect the bargaining position or negotiating
strategy of the City. William J ones seconded the motion.

J ane J ohnson motioned to reconvene at 8:16 p.m. and that in accordance with
Section 2.2-3712D of the C ode of Virginia, 1950 as amended to date, C ouncil
hereby certifies that in C losed Session only items lawfully exempted from open
meeting requirements under the Virginia Freedom of Information Act and only such
items identified in the motion by which the Closed Session was convened were
heard, discussed, or considered by the Council. William J ones seconded the
motion.
