PLANNING COMMISSION WORK SESSION
June 12, 2019
A work session of the Planning Commission of the City of Salem, Virginia, was held
in Council Chambers Conference Room, City Hall, 114 North Broad Street, at 6:30 p.m., on
June 12, 2019, there being present the following members of said Commission, to wit: Vicki
G. Daulton, Chair; Denise P. King, Vice Chair (absent); Reid A. Garst II, N. Jackson Beamer,
and Neil L. Conner; together with James E. Taliaferro, II, Interim City Manager and
Executive Secretary, ex officio member of said Commission; Benjamin W. Tripp, City
Planner; and William C. Maxwell, Assistant City Attorney; and the following business was
transacted:
The Executive Secretary reported that this date, place, and time had been set in
order for the Commission to hold a work session; and
In re: Hold public hearing to consider adopting Resolution of Recommendation
regarding The Downtown Salem Urban Development Area (UDA) plan
and for amending the “Comprehensive Plan of the City of Salem, Virginia”
to reflect the addition (continued from the May 15, 2019, meeting)
WHEREAS, staff noted the following regarding the request: in 2015, the City of
Salem adopted several Urban Development Areas (UDAs) as part of the Comprehensive
Plan, one of which encompasses Downtown and is known as the City Core UDA. Urban
Development Areas identify areas that have transportation needs where the locality wishes
to direct state transportation dollars. Expanding on the UDA program and in conjunction
with the City’s consultants Rhodeside & Harwell, the attached Downtown UDA Study is
presented; and
WHEREAS, staff and the Commission held a discussion regarding the request to
consider adopting a Resolution of Recommendation regarding The Downtown Salem Urban
Development Area (UDA) plan and for amending the “Comprehensive Plan of the City of
Salem, Virginia” to reflect the addition.
THEREUPON, the Commission took no action at this work session.
There being no further business to come before the Commission, the work session
was adjourned at 6:55 p.m.

A.Downtown Salem Urban Dev elopment Area
Hold public hearing to consider adopting Resolution of Recommendation regarding

Salem Urban Development Area (UD A) Study and for amending the
“C omprehensive Plan of the
City of Salem, Virginia” to reflect the addition. (C ontinued from the May 15, 2019,
meeting.)
T he Executive Secretary noted this item was continued from the May 15, 2019,
meeting. He noted the actual request is for the Commission to recommend to C ity
C ouncil to adopt the Resolution of Recommendation regarding T he Downtown
Salem Urban Development Area (UD A) plan. T here is no resolution for Planning
C ommission to pass this evening.
Staff noted the following regarding the request: in 2015, the City of Salem adopted

Mr. Tripp noted the document before the C ommission was prepared by Rhodeside
and Harwell through a grant program paid for by the state. T he program looks at
urban development areas and helps localities to develop those areas as part of the
V-Trans and Smart Scale planning process. He noted the Downtown Salem UD A is
a collection of ideas and suggestions which could be looked at in the future that
carry on the goals and outline that is contained in the Downtown Plan. He further
noted he would be glad to answer any questions the C ommission might have
regarding the document.
C hair Daulton noted this is a public hearing and asked if there was anyone present
who would like to speak regarding this matter. T here was no response, and the
public hearing was closed.
Reid Garst motioned to recommend to the Council of the City of Salem to adopt a
Resolution of Recommendation regarding the Downtown Salem Urban Development
Area (UD A) plan and for amending the "Comprehensive Plan of the City of Salem,
Virginia" to reflect the addition. Neil Conner seconded the motion.

RE: Hold public hearing to consider the request of R. Fralin Companies, Inc, contract purchaser,
for rezoning the property located at 211 Diamond Road and 135 Diamond Road (Tax Map #s 272
- 2 - 1 and 273 - 2 - 1) from AG - Agriculture District / RSF - Residential Single Family District to
RSF Residential Single Family District.

BACKGROUND INFORMATION:
The subject property is commonly known as “The Simms Farm”, and consists of two parcels land
of approximately 65.5 acres, bounded by Franklin Street on the west, Upland Drive on the south,
Diamond Road on the east, and a private portion of Homeplace drive to the north. The property
was until recently used for the stabling of horses, and is currently occupied by a main, centrally
located residence, a secondary residence, and a variety of barns and other agricultural buildings.
This request is to rezone the property to allow it to be developed into a new residential
neighborhood consisting of 104 single-family detached houses, and 43 single-family attached
houses, for a total of 147 new units. The development would include several new public streets,
public sidewalks, pedestrian streetlights, street trees, public walking trails, a community pool, and
a minimum of 20 acres (approximately one-third of the site) of dedicated open space. The single-
family attached houses would be located on a separate, privately maintained street.
The applicant is proposing two entrances to the property. The primary entrance would be located
at the intersection of Westclub Drive and Upland Drive, and would change the current two way
stop intersection to a four way stop (all way stop). A secondary entrance would be located on
Diamond Road. The initial concept that was submitted to the city showed two other connections,
one onto Homeplace Drive, and one through the private road back onto Upland Drive. Those two
connections have been eliminated.
ISSUES:
The applicant is proffering substantial conformance with the presented Master Plan. This is
similar to what was done with the nearby Heritage Downs subdivision.
This request is related to the request for a Special Exception Permit to allow Single Family
Attached homes in the RSF zoning. That request requires a separate public hearing, and would
be contingent on this rezoning being granted.

RE: Hold public hearing to consider the request of R. Fralin Companies, Inc., contract purchaser,
for the issuance of a Special Exception Permit to allow Single-Family Dwellings, Attached with
proffered conditions on the property located at 211 Diamond Road (Tax Map # 272 - 2 - 1).

BACKGROUND INFORMATION:
The subject property is a portion of what is commonly known as “The Simms Farm”. It consists
of a single parcel of land of approximately 62.5 acres, bounded by Franklin Street on the west,
Upland Drive on the south, Diamond Road on the east, and a private portion of Homeplace drive
to the north. The property was until recently used for the stabling of horses, and is currently
occupied by a main, centrally located residence and a variety of barns and other agricultural
buildings.
This request is to for the issuance of a Special Exception Permit to allow up to 43 single family
attached houses within Single-Family Residential zoning, as indicated on the Master Plan. These
units would be located on a new private street, generally parallel to Upland Drive, near the
proposed main entrance that is aligned with Westclub Drive.
The initial concept that was submitted to the city showed the private road connecting to Upland
Drive. This connection has been eliminated and the developers are instead proposing a cul-de-
sac.
ISSUES:
The applicant is proffering substantial conformance with the presented Master Plan. This is
similar to what was done with the nearby Heritage Downs subdivision.
This request is related to the request to rezone the entire property from Agricultural to Single-
Family Residential. This request cannot be considered unless the rezoning has been approved.

BACKGROUND INFORMATION:
The subject property consists of a single parcel of 0.406 acres, located on the south side of
Roanoke Boulevard, to the west of the intersection with Easton Road. The property contains a
one-story vinyl-sided office/commercial building.
Corbin’s Confections opened in 2016 at 18 East Main Street, as a gluten free, peanut free, and
tree nut free bakery. Having outgrown their current location, they wish to relocate the
manufacturing to 1618 Roanoke Boulevard. The product will be transported to the storefront for
sale, and shipped both retail and wholesale, directly to customers. The proposed location on
Roanoke Boulevard could potentially house a second retail storefront and/or a restaurant.
However, on October 10, 2011, City Council approved to rezone the property from Residential
Business District RB to Highway Business District HBD with the following condition:
(1) The only HBD Highway Business District uses for the property will be general offices,
medical office/clinics, antique shops, business support services, consumer repair
services, personal improvement services, personal services, retail sales, and fine arts
studio.
This request is to amend the conditions to allow the property to be used for custom manufacturing
and restaurant in addition to the currently allowed uses.

AN ORDINANCE TO AMEND SECTION 106-110, ARTICLE I, CHAPTER 106, OF THE CODE OF THE
CITY OF SALEM, VIRGINIA, RELATING TO ZONING AND DIVIDING THE CITY INTO BUILDING
DISTRICTS AND ESTABLISHING DISTRICT BOUNDARY LINES ON THE ZONING MAP OF THE CITY
OF SALEM, VIRGINIA.
WHEREAS, Ronkeith and Judith Ann Adkins, property owners, have heretofore
petitioned to have the property located at 1618 Roanoke Boulevard (Tax Map #222-2-4)
rezoned from RBD Residential Business District to HBD Highway Business District; and
WHEREAS, in said petition, Ronkeith and Judith Ann Adkins, property owners, did
voluntarily proffer a written condition in addition to the regulations provided for in HBD
Highway Business District into which this property is requested to be rezoned; and
WHEREAS, Council has reviewed the proposed condition and is of the opinion that the
requested rezoning without the proposed condition would not be in the best interests of the
City and that the condition proffered will more closely comply with the intent of the Land Use
Plan heretofore adopted; and
WHEREAS, Council has adopted the provisions of Chapter 320 of the 1978 Acts of the
General Assembly of Virginia, Sections 15.2-2296 through 15.2-2302, relating to conditional
zoning; and
WHEREAS, the Planning Commission at its regular meeting held on September 14, 2011,
did recommend to Council after holding a public hearing that such rezoning be approved with
the voluntarily proffered condition; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, VIRGINIA, that Section 106-
110, Article I, Chapter 106, of The Code of the City of Salem, be amended, revised, and
reordained to read as follows and the map referred to shall be changed in this respect and no
other:
Section 1. That the following described property, presently zoned RBD Residential
Business District in the City of Salem, be and the same is hereby
changed from RBD Residential Business District to HBD Highway
Business District and the map referred to shall be changed in this
respect and no other. However, in addition to the regulations for
such zoning district as contained in Chapter 106 of The Code of
the City of Salem, Virginia, there is hereby incorporated the
condition set forth in Section 2 of this ordinance to the same
extent and purpose as though such conditions were herein fully
set out at length:
BEGINNING at a point on the southwesterly side of Roanoke
Boulevard which point is S. 50° 2” E. 207.0 feet from the point of
intersection of Roanoke Boulevard and Alberta Drive; thence
continuing with the southwesterly line of Roanoke Boulevard S.
50° 2” E. 118.0 feet to a point; thence S. 39° 56” W. 150.0 feet to
a point; thence N. 50° 02” W. 118.0 feet to a point; thence N. 39°
56’ E. 150.0 feet to the point of BEGINNING, and being all of Lot
5, and the southeasterly 53 feet of Lot 4, according to the map
made for C. R. Peters, proposed subdivision of Lots 23, 23, & 25,
Map of Fairfield, which said map is recorded in Plat book 1, Page
318, in the Clerk’s Office of the Circuit Court for the County of
Roanoke, Virginia, and as shown on Plat recorded in Deed Book
27, Page 520, in the Clerk’s Office of the Circuit Court for the City
of Salem, Virginia.
BEING the same property conveyed to Ronkeith Adkins, et ux.,
from Curtis W. Fitzgerald, et als., by deed dated October 31,
1980, of record in the Clerk’s Office of the Circuit Court for the
City of Salem, Virginia, in Deed Book 70 at page 339.
Section 2. The following condition voluntarily proffered shall apply in addition to
the regulations contained in Chapter 106 of The Code of the City
of Salem:
1. The only HBD Highway Business District uses for the
property will be general offices, medical office/clinics,
antique shops, business support services, consumer repair
services, personal improvement services, personal
services, retail sales, and fine arts studio.
All ordinances or parts of ordinances in conflict with the provisions of this ordinance be
and the same are hereby repealed.
This ordinance shall be in full force and effect ten (10) days after its final passage.

The Council of the City of Salem at its regular meeting held on October 10, 2011, passed
an ordinance on second reading with a voluntarily proffered condition rezoning the property of
Ronkeith and Judith Ann Adkins, property owners, located at 1618 Roanoke Boulevard (Tax
Map #222-2-4) from RBD Residential Business District to HBD Highway Business District.
This Amendment to the Zoning Ordinance is number 304. A copy of this ordinance is
attached for your information.

The subject property consists of .402-acre parcel located on the southwest of the intersection of
Union Street and Eddy Avenue. The parcel is occupied by a one and a half story brick office
building. The property is located entirely within the FEMA designated floodway.
This request is for a Use Not Provided For Permit to allow the relocation of the Salem Food Pantry.
The Pantry provides food and financial assistance to people in need. The Pantry has been located
in donated space on Chapman Street for the last several years. They were notified that they would
have to vacate their space due to Novozymes’ expansion. The property at 915 Union Street meets
all their criteria for space, accessibility, and location.
ISSUES:

issuance of a Special Exception Permit to allow a 1,286 square foot detached garage on the
property located at 208 Northern Trail (Tax Map # 10 - 1 - 1.9).

BACKGROUND INFORMATION:
The subject property consists of a single parcel of approximately 1.2 acres, located in the cul-de-
sac of Northern Trail, east of the intersection of Northern Trail and Polar Lane. The property is
occupied by a single-family residence.
On July 9, 2007, City Council approved the rezoning from AG, Agriculture District to RSF,
Residential Single-Family District with conditions. The conditions are as follows:
1. All lots shall meet all zoning requirements including the minimum road frontage requirements;
2. Sight distance requirements shall be met for the proposed intersection; and
3. Building requirements of no vinyl, only brick and stone foundations, architectural shingles,
paved driveways, and stone and landscaped entranceway.
The applicant is requesting a Special Exception permit to allow a garage over 1,000 sq. ft.
ISSUES:
The garage would be located within the eastern side yard. A variance to allow the garage in the
side yard was granted by the Board of Zoning Appeals on July 25th, 2019.
ALTERNATIVES:
1) Recommend approval of the Special Exception Permit to City Council as submitted.
2) Recommend approval of the request with conditions not yet received.
3) Recommend denial of the request.
