PLANNING COMMISSION
December 11, 2013
A regular meeting of the Planning Commission of the City of Salem, Virginia, was held in
Council Chambers, City Hall, 114 North Broad Street, at 7:00 p.m., on December 11, 2013, there
being present the following members of said Commission, to wit: Bruce N. Thomasson, Jimmy
W. Robertson, and Samuel R. Carter, III (Vicki G. Daulton and Denise P. King – absent); with
Bruce N. Thomasson, Vice Chair, presiding; together with James E. Taliaferro, II, Assistant City
Manager and Executive Secretary, ex officio member of said Commission; Melinda J. Payne,
Director of Planning and Development; William L. Simpson, Jr., Assistant City Engineer;
Benjamin W. Tripp, Planner; Judy L. Hough, Planner; Mary Ellen Wines, Deputy Zoning
Administrator/Secretary; and William C. Maxwell, Assistant City Attorney; and the following
business was transacted:
DUE TO EQUIPMENT MALFUNCTION, THESE MINUTES WERE PREPARED WITHOUT THE
ASSISTANCE OF AUDIO RECORDING.
ON MOTION MADE BY COMMISSION MEMBER ROBERTSON, SECONDED BY
COMMISSION MEMBER CARTER AND DULY CARRIED, the minutes of the regular meeting and
work session held on November 13, 2013, were approved as written – the roll call vote: all
present - aye.
In re: Hold a public hearing to consider the request of Irvin L. and Jonny Jean
Webster, property owners, for rezoning the property located at 429 S.
Market Street (Tax Map # 145-10-10) from RSF Residential Single Family
District to HBD Highway Business District
The Executive Secretary reported that this date and time had been set to hold a public
hearing to consider the request of Irvin L. and Jonny Jean Webster, property owners, for
rezoning the property located at 429 S. Market Street (Tax Map # 145-10-10) from RSF
Residential Single Family District to HBD Highway Business District; and
WHEREAS, the Executive Secretary further reported that notice of such hearing had
been published in the November 27, and December 4, 2013, issues of The Roanoke Times, and
adjoining property owners were notified by letter mailed November 27, 2013; and
WHEREAS, staff noted the following: the subject property consists of a single parcel
located on the west side of South Market Street at the intersection with Third Street; the
property is currently vacant; this application is to rezone the property from RSF Residential
Single Family to HBD Highway Business District, in order to allow the construction of a
warehouse and office building; a large portion of this property lies within the floodway, and the

remainder lies within the other associated flood zones; in accordance with Sec. 106-400, the
construction of a new building on this site will require a site plan, and may require stormwater
management, landscaping, and paved parking areas, as well as other requirements; and
WHEREAS, Irvin Webster of 910 E. Eighth Street, property owner, appeared before the
Commission explaining the rezoning request to the Commission; he explained that his son,
Corey Webster, has taken over the family business, Salem Painting and Services, and they are
proposing to build a 25’ X 40’ building for an office and warehouse for the business on this
property; and
WHEREAS, Tim Cannaday of 426 S. Market Street appeared before the Commission in
opposition to the request; and
WHEREAS, Donna Tinnel, representing the property owner of 424 South Market Street,
appeared in opposition to the rezoning request; she noted that they already have flooding
issues in this area of South Market Street and adding more blacktop will make the situation
even worse; in addition, she noted that with the business use it will cause an increase in traffic
in their neighborhood; further, they already have problems with people speeding, and the
proposed business will add to the situation; and
WHEREAS, Mr. Webster noted that the warehouse will only be used for storage of
equipment and paint; they will not be doing any painting at this location; further, there will be
very little traffic associated with the business; the workers will come there in the mornings to
pick up paint, etc. and then go to their job sites in the company vehicles; they have been in
business for 40 years and would not do anything that would be detrimental to the
neighborhood; also, in regards to speeding on the street, this should be left up to the Police
Department to address; and
WHEREAS, Commission Member Robertson asked approximately how many vehicles
would be coming and going to the business, and Mr. Webster noted that there would be 4 to 5
vehicles; and
WHEREAS, Ms. Tinnel asked how could they be assured the proposed development
would not cause further problems related to flooding; and
WHEREAS, Will Simpson and Ben Tripp discussed storm water management; and it was
noted that the proposed development cannot increase the amount of runoff that currently
flows from the property onto adjacent properties; and

WHEREAS, Ms. Tinnel again noted the proposed business will increase traffic and also
cause problems for the adjacent neighbor who parks on the street; she noted with the business
being so close to his property, there will more than likely be an accident; and
WHEREAS, there was further discussion about traffic and speeding, etc., and it was
noted that the Salem Police Department should be contacted with regards to the vehicles who
are speeding; and
WHEREAS, Jonny Webster of 910 E. Eighth Street, property owner, appeared in support
of the request; and
ON MOTION MADE BY COMMISSION MEMBER ROBERTSON, SECONDED BY
COMMISSION MEMBER CARTER, AND DULY CARRIED, the request of Irvin L. and Jonny Jean
Webster, property owners, for rezoning the property located at 429 S. Market Street (Tax Map
# 145-10-10) from RSF Residential Single Family District to HBD Highway Business District be
approved – the roll call vote: all present – aye.
There being no further business to come before the Commission, the same on motion
adjourned at 7:23 p.m.
