White, property owner, for rezoning a portion of the property located in the 1400 block of West Riverside Drive (Tax Map # 178-3-7) from AG Agricultural District to RSF Residential Single Family District; and WHEREAS, the Executive Secretary further reported that notice of such hearing had been published in the November 2 and 9, 2006, issues of the Salem Times-Register, and adjoining property owners were notified by letter mailed November 3, 2006; and 2 WHEREAS, staff noted the following: the subject property consists of one parcel located along West Riverside Drive, directly to the east of the Woodbridge Subdivision; currently, there are two single family dwellings on the property, and the remainder is used for agriculture; the lot is approximately 12.241 acres; the portion along West Riverside Drive is located within the floodway and the associated flood zones; this request is to subdivide the property into three parcels, one for each of the current dwellings, and a larger parcel constituting the remainder of the original property; Parcel A2 (.293 acres) will be located around 1498 W. Riverside Drive and Parcel A3 (.497 acres) around 1494 W. Riverside Drive; an additional dwelling is proposed on the remaining property (Parcel A1, 11.451 acres); since Parcels A2 and A3 are less than the required ten acre minimum to qualify for the Agricultural District zoning, the property owner is requesting that they be rezoned to RSF (Residential Single Family); Parcel A1 will remain AG (Agricultural); the dwellings located at 1498 and 1494 are partially located within the floodway, however, they are currently existing structures; and the proposed dwelling located on Parcel A1 is not within any flood boundaries; and WHEREAS, Brian Casella of Balzer & Associates, Roanoke, representing the property owner, appeared before the Commission explaining the request to rezone a portion of this property from AG Agricultural District to RSF Residential Single Family District; he noted that the purpose of the request is to allow Mr. & Mrs. White to construct a new single-family residence for their personal use on proposed Parcel A-1, which will remain agriculturally zoned; and WHEREAS, Commission Member Robertson stated he noticed the rather lengthy driveway accessing the proposed new dwelling; he asked Mr. Casella if the proposed driveway would be a gravel road, and Mr. Casella noted that it would be a gravel driveway; and 3 WHEREAS, Commission Member Daulton noted that she was not able to attend the work session earlier in the day; she asked if the proposed dwelling would be single family, and Mr. Casella noted that it would be a single family dwelling and that it would be the White’s primary dwelling; and WHEREAS, Fred and Charlotte White, property owners, appeared before the Commission in support of the request; and WHEREAS, no other person(s) appeared related to said request; ON MOTION MADE BY COMMISSION MEMBER ROBERTSON, AND DULY CARRIED, the Planning Commission of the City of Salem doth recommend to the Council of the City of Salem that the request of Charlotte K. White, property owner, for rezoning a portion of the property located in the 1400 block of West Riverside Drive (Tax Map # 178-3-7) from AG Agricultural District to RSF Residential Single Family District be approved as presented – the roll call vote: all present – aye.
