Hold a public hearing to receive the views of citizens within the School Division regarding
the School Board appointment for the expiring term ending December 31, 2023 of one
member of the City of Salem School Board. (As advertised in the September 7, 2023, issue of
the Salem-Times Register).
B.Special Exception Permit
Hold public hearing to consider the request of David A. Thompson, property owner, for the
issuance of a Special Exception Permit to allow a 1,500 square foot detached garage on the
property located at 640 Joan Circle, (Tax Map # 243 -2 - 16). (Advertised in the September
14 and 21 issues of the Salem Times-Register.) Planning Commission recommended denial
see pages 2-5 of the September 13, 2023, minutes. STAFF REPORT

Consider concept change for 630 Union Street.

WORK SESSION
1.Call to Order
A work session of the Council of the City of Salem, Virginia, was held in the
Council Chambers Conference Room, City Hall, 114 N. Broad Street, Salem,
Virginia, on September 11, 2023, at 6:00 p.m., there being present the following
members of said Council to wit: Renée Ferris Turk, Mayor (participated
remotely); James W. Wallace, III, Vice- Mayor (participated remotely); Council
members: Byron Randolph Foley, William D. Jones, and H. Hunter Holliday;
with Byron Randolph Foley, presiding together with James E. Taliaferro, II, City
Manager; Rob Light, Assistant City Manager and Clerk of Council; Rosemarie B.
Jordan, Director of Finance; Crystal Williams, Assistant to the City Manager;
Laura Lea Harris, Deputy Clerk of Council; and Mark Popovich, on behalf of Jim
Guynn, City Attorney; and the following business was transacted;
Mr. Foley reported that this date, place, and time had been set in order for the Council to hold a work session.
A.Discussion Items
Follow up to discussion on Citizen Comment requests.
Continued discussion was held on Citizen Comment requests from the August 14
and August 28, 2023, Council meetings. Mr. Foley noted that there was no action
that Council could take on the Hope Tree items until the City actually had a
proposal from them.
Work Session times were discussed. There was no support for changing the time
and/or day.
Discussion was held on Code enforcement. It was noted that input from
Community Development, the City Manager, and the Assistant City Manager were
needed in order to fully review this request as well as in-depth thought and
discussion.
Mr. Wallace requested that Council direct the City Manager and Assistant City
Manager to direct Community Development that a formal response must be
given to Zoning Violation complaints. Discussion of various options and
subsequent questions/comments as to how this could work was held.

Mr. Light requested that staff be given time to discuss this with Community
Development to better understand the specifics of their current process, gather
their feedback, and subsequently follow back up with Council.

1. Call to Order
A regular meeting of the Council of the City of Salem, Virginia, was called to order
at 6:30 p.m., there being present the following members to wit: Renée Ferris Turk,
Mayor (participated remotely); James W. Wallace, III, Vice-Mayor (participated
remotely); Councilmembers: Byron Randolph Foley, William D. Jones, and H.
Hunter Holliday; with Byron Randolph Foley presiding together with James E.
Taliaferro, II, City Manager; Rob Light, Assistant City Manager and Clerk of
Council; Rosemarie B. Jordan, Director of Finance; Chuck Van Allman, Director
of Community Development; Mike Stevens, Director of Communications; and
Mark Popovich, on behalf of Jim Guynn, City Attorney.
William Jones motioned to make Randy Foley chairman for City Council for the
September 11, 2023, Regular meeting of Council. Hunter Holliday seconded the
motion.
Ayes: Foley, Holliday, Jones
Abstain: Turk, Wallace
2. Pledge of Allegiance
A moment of silence was recognized after the Pledge in remembrance of September
11, 2001.
3. Bid Openings, Awards, Recognitions
There were none this evening.
4. Consent Agenda
Mr. Foley requested that Mr. Light read a request from Mayor Turk and Vice-
Mayor Wallace to participate remotely in this Council meeting.
The request from Mayor Turk stated: "In accordance with Section 2.2-3708.3 B.4
of the Code of the Commonwealth of Virginia and the Remote Participation Policy
of the City of Salem, I hereby request to participate remotely for a personal matter,
specifically that I am out of town."
The request from Vice-Mayor Wallace stated: "In accordance with Section 2.2-
3708.3 B.4 of the Code of the Commonwealth of Virginia and the Remote
Participation Policy of the City of Salem, I hereby request to participate remotely
for a personal matter, specifically that I am out of town."
William Jones motioned to accept the remote participation of Mayor Turk and Vice-
Mayor Wallace. Hunter Holliday seconded the motion.

A. Citizen Comments
Comments from the public, limited to five minutes, on matters not already
having a public hearing at the same meeting.
Michael Bentley, 312 North Broad Street, was the first citizen to address Council.
He expressed concern about the proposed Hope Tree redevelopment. He
specifically was concerned about overgrowth and potentially negative consequences
to the historic neighborhood, such as traffic, infrastructure, and school capacity. He
expressed concern about the environmental costs of more development and less
green space and said that he felt there was a need for planning to retain existing
green spaces and that other spaces should be utilized for new housing. Mr.
Bentley requested that Salem City Council not approve rezoning of the Hope Tree
property.
Christina McCart, 316 North Borad Street, was the last person to address Council
this evening. She urged Salem to determine the effects on current neighborhoods of
proposed rezoning prior to granting. She expressed concern about traffic. She
suggested a simulation to model impacts on traffic reflecting both current load of
automobiles and projected numbers. She expressed the concern that this might
decrease value and condition of neighborhood. She requested that Council get all
facts before making a decision on rezoning. She requested detailed analysis of
traffic flow, water runoff, increased load on schools, increased load on all city
infrastructure, and demand for multifamily housing. She requested that before
voting for any zoning changes, Council get developers to provide specific
information on number of units and full impact on residents of Salem. She asked
that the impact on the value of homes of current residents be considered as well.
B. Minutes
Consider acceptance of the August 28, 2023, Work Session and Regular
Meeting minutes.
The minutes were approved as written.
5. Old Business
A. Amendment to the Zoning Ordinance
Consider ordinance on second reading for the request of Helm Building
Enterprises Ltd., property owner, for rezoning the property located at 105 St.
John Road (Tax Map # 155-3-2) from HBD Highway Business District to HM
Heavy Manufacturing. (Approved on first reading at the August 28, 2023,
meeting.)
William Jones motioned to adopt ordinance on second reading for the request of

6. New Business
A. Appropriation of Funds
Appropriate Virginia Tourism Corporation (VTC) ARPA Sports Marketing
Incentive Program Grant for Stagg Bowl. Audit - Finance Committee
The City of Salem was awarded an American Rescue Plan Act (ARPA) Marketing
Incentive Program grant through Virginia Tourism Corporation in the amount of
$20,150. Funds will be used for personnel and radio advertising expenses for the
Amos Alonzo Stagg Bowl that will be held in December 2023. No local match is
required. Grant proceeds will cover the cost of items not included in the FY24
operating budget.
William Jones motioned to appropriate $20,150 in ARPA Sports Marketing
Incentive Program grant revenue and increase the budget for ARPA Sports
Marketing Incentive Program grant expenditures by $20,150. H Hunter Holliday
seconded the motion.

B. Appropriation of Funds
Appropriate excess local funding due to utilization of American Rescue Plan
Act (ARPA) funding. Audit - Finance Committee
The City was awarded ARPA funding in the amount of $31,164,631. In the fiscal
year 2023 budget, $25,950,000 was appropriated in the General Fund, freeing up
local funds for other uses. In fiscal year 2023, excess local funds of $15,622,584
were appropriated in the Capital Projects Fund and excess local funds of
$9,456,916 were appropriated in the Water and Sewer Capital Fund.
The fiscal year 2023 budget for the Water and Sewer Capital Fund needs to be
increased by $870,500 to reflect the correct excess local funding for the North
Salem Water Improvement project.
The fiscal year 2024 adopted budget for the General Fund includes the remaining
ARPA funding for general government services. Utilizing these funds for general
government services is an eligible use of funds per guidance issued by the United
States Department of the Treasury and will free up local funds for other uses.
Excess local funds of $1,963,047 need to be appropriated in the Capital Projects
Fund as a reserve for future projects. Excess local funds of $3,247,584 need to be
appropriated in the Water and Sewer Capital Fund to fully fund the North Salem
Water Improvement project.
Federal funding of $5,210,631 will be used to cover general government services in
the General Fund, freeing up local funds for other uses.
William Jones motioned to appropriate $870,500 in the Water and Sewer Capital
Fund in fiscal year 2023 to the Transfer From General Fund account and to the
North Salem Water Improvement account. Also to appropriate $1,963,047 in the
Capital Projects Fund in fiscal year 2024 to the Transfer From General Fund
account and to the Excess Local Funding Reserve account. In addition, appropriate
$3,247,584 to the Water and Sewer Capital Fund in fiscal year 2024 to the Transfer
From General Fund account and to the North Salem Water Improvement account. H

C. Appropriation of Funds
Consider request to re-appropriate funding for various capital items. Audit -
Finance Committee
In previous fiscal years, funds were budgeted for capital items that were not
purchased for various reasons. Attached is a list of projects that need to have
funding reappropriated in fiscal year 2024. Re-appropriated funds will be used to
cover the cost of equipment and projects.
Mr. Foley shared for the benefit of the public that this funding will be used for
police vehicles, caulking at Salem Stadium, parking lot resealing at Salem Stadium,
and a consultant for the Civic Center to determine its best future use.
William Jones motioned to re-appropriate fund balance of $210,964. Increase the
Designation of Beginning Fund Balance account by $210,964 and increase the
budget for accounts listed on the attachment in the agenda packet for the purpose
stated above. In addition, appropriate $50,000 in net position in the Civic Center
fund account and increase the budget in the Other Professional Services account by
$50,000. H Hunter Holliday seconded the motion.

D. Appropriation of Funds
Consider request to amend the School Cafeteria Fund budget as approved by
the School Board on August 8, 2023. Audit - Finance Committee
The School Cafeteria Fund budget was amended for fiscal year 2022-2023 by the
School Board at their meeting on August 8, 2023. The Board amended the Cafeteria
Fund budget to increase revenues and expenditures by $120,000.
William Jones motioned to approve the School Board’s appropriation changes of
$120,000 be made to the Cafeteria Fund as amended at the August 8, 2023, School
Board meeting. H Hunter Holliday seconded the motion.

E. Salem Band Boosters
Consider request from the Salem Band Boosters for a donation ($4,422.46)
equal to the amount of admissions tax paid in connection with the annual Drum
Corps International Summer Music Games competition held on August 1, 2023,
at the Salem Stadium.
William Jones motioned to approve the request from the Salem Band Boosters for a

the School Division regarding the School Board appointment
for the expiring term ending December 31, 2023, of one
member of the City of Salem School Board.

SUMMARY OF INFORMATION:
City Council is holding a public hearing pursuant to section 22.1 -29.1 of the Code of
Virginia as amended to receive citizen views regarding filling the expiring term ending
December 31, 2023, of David Preston for the City of Salem School Board.
As advertised in the Thursday, September 7th edition of the Salem Times-Register, all
candidates seeking appointment must submit a letter of interest and resume prior to the
end of this public hearing.
Applications received by the Clerk’s office prior to the issuance of this agenda package
are included for review.

Please allow this letter to serve as my notice of interest to serve on the Salem City School
Board, with a three year term commencing on January 1, 2024.
I feel that I would be a dedicated and enthusiastic addition to the school board, that would
provide a fresh prospective. It is important to me to that our school system continues to
thrive and be highly regarded as we face both new challenges and opportunities. Not only for
our current students, teachers and staff, including my own children, but to ensure that the
Salem City School system has a clear path for success and achievable long term goals.
Although I am not originally from Salem, I have made it my home and carved out my place in
the community. From my time at G & H Contracting, administrating the construction of
South Salem Elementary School, to serving on the Salem Sport Foundation board, raising
funds and supporting student athletes at Salem High School, I am emersed in the Salem
Community and see serving on the school board as another way to stay involved and shape
the future of the community, who’s base is truly the school system.
If I was nominated for the Salem City School board position, I would strive to serve all
students and faculty members. I feel it is the school boards job to plan and set a path way
that empowers everyone under their direction to succeed. The challenge is that this path is
different for each individual and is ever evolving. Therefore the School Board has to strike a
balance between the traditions of what we know works and modern, forward thinking to best
serve the community.

Work Experience
VDOT – February 25, 1999, to March 1, 2022
My career with VDOT began as a Project Manager responsible for managing road design for
projects funded through the State’s Six Year Program. I worked in the Salem District Location and
Design Section providing budget, schedule and design leadership for road projects throughout the
District.
I moved from the District Location and Design Section to be the Assistant Resident Engineer in the
Salem Residency responsible for Land Development and Maintenance for the Counties of
Roanoke, Botetourt, and Craig. I accepted the job as Assistant Resident Engineer in the Ashland
Residency so I could gain greater experience in VDOT’s construction processes and procedures. I
continued my responsibilities for Land Development while adding Construction Responsibilities. I
covered the Counties of Hanover and Goochland.
I was then selected to be the Resident Engineer in the Petersburg Residency where I had
Construction, Maintenance and Land Development responsibilities in Dinwiddie and Prince
George Counties. I was selected to be the District Maintenance Infrastructure Manager for the
Salem District where I was responsible for the District Maintenance Operations and Budget. From
there I was selected as the Resident Engineer for the Salem Residency where I was responsible for
Maintenance and Land Development within Roanoke, Botetourt, and Craig counties.
Anderson & Associates, Inc – June 1979 to February 24, 1999
I worked for Anderson & Associates three times in my experience as a consulting engineer. I
worked for them first while I was in college during the summer of 1979. During that time, I
worked on the survey crews doing various types of surveys but primarily boundary surveys,
topographic surveys, and construction stakeout.
During my second employment (July 1991 to July 1998), I worked on both municipal and private
sector projects. Municipal projects were primarily water, sanitary sewer and storm sewer system
development and extension. The land development projects included subdivisions, apartment
complexes, industrial parks, and individual site design, e.g. retail stores and manufacturing plants.
I started as the designer and them moved up to Project Management.
In my last employment (July 1991 to February 24, 1999), I began as a project manager and then
took on the responsibilities as the Vice-President for Land Development.
Lucas Construction and Development - October 1989 to July 1991
This was the most enjoyable job I had in my private sector career. Lucas C&D evaluated, bought,
and developed retail and housing projects. I was involved with the site evaluation, site selection,
and development of all projects. I had full control of all surveying, design, and construction of
each project.
Virginia Tech - Adjunct Professor – September 1986 to May 1998
During my tenures at Lucas C&D and Anderson & Associates, I taught part-time at Va Tech for
the Civil Engineering Department. The subjects I taught were Land Development Design and
Property Line Law.
Education
I have both a Bachelor’s and Master’s Degree in Civil Engineering from Va Tech and an
Associate’s Degree in Engineering from Southwest Virginia Community College.
Professional Registration
I currently hold active registrations as a Licensed Professional Engineer (PE) and a Licensed Land

The subject property (640 Joan Circle, Tax Map # 243-2-16) consists of a 1.05 acre tract of land that
sits within the RSF Residential Single Family zoning district. The applicant has submitted building
plans to construct an accessory structure on his property; however, because the proposed plans
indicate a square footage of greater than 1,000 (1,500 square feet), a Special Exception Permit is
required.
If approved, the building plans indicate that the structure will be constructed on a concrete pad with
a combination of masonry, vinyl siding, and asphalt shingles. The structure will be required to adhere
to the site development regulations prescribed in Section 106-202.3. (B) 2. Accessory Structures of

1. Call to Order A work session of the Planning Commission of the City of Salem, Virginia, was held in
Council Chambers Conference Room, City Hall, 114 North Broad Street, Salem, Virginia,
at 6:00 p.m. on September 13, 2023; there being the members of said Commission, to wit:

1. Call to Order
A regular meeting of the Planning Commission of the City of Salem, Virginia, was held
after due and proper notice in the Council Chambers, City Hall, 114 North Broad Street,
Salem, Virginia, at 7:00 p.m., on September 13, 2023. Notice of such hearing was
published in the August 31 and September 7, 2023, issues of the "Salem Times Register," a
newspaper published and having general circulation in the City of Salem. All adjacent
property owners were notified via the U. S. Postal Service.
The Commission, constituting a legal quorum, presided together with Jim H. Guynn, Jr.,
City Attorney; Mary Ellen Wines, Planning & Zoning Administrator; and Charles E. Van
Allman, Jr., Director of Community Development, and the following business was
transacted:

Staff noted the following:

David Thompson, property owner, appeared before the Commission and stated that he has
lived at the residence since 1981. His grandchildren outgrew the swimming pool on the
property; therefore, he plans to fill in the pool and place a garage, not to work out of, but to
store cars. He has been a collector for years. He stated that the roofline will be maybe a foot
taller than the roofline on his house. He stated that the neighbor's house to the left of his
property is probably 12-foot taller than his house-- other than that it does not affect anyone.
Chair Daulton questioned if the garage was going to be a foot taller than his
residence.
Mr. Thompson confirmed that it would be, and Chair Daulton asked how tall it would be.
He stated that his house is 11-foot tall, and the garage will be 12-foot tall.
The Zoning Administrator clarified that accessory buildings cannot be taller than the main
house, but one side is two-stories, and the other side is one-story; therefore, the average
height of Mr. Thompson's residence is around 18-feet. She then asked Mr. Thompson how
tall the garage would be.
Mr. Thompson stated that the garage would be 16-feet tall. He further stated that the plans
show the garage being vinyl sided, but he plans to brick up 4-feet and then vinyl side with
arch shingles. He stated that he has a nice home and wants to make the garage nice for
everyone.
Member Beamer questioned if Mr. Thompson would access the garage from the lower
driveway on the left when facing his property. Mr. Thompson stated that he would and
make a circle behind.
Vice Chair King noted that Mr. Thompson already has a two-bay garage and a
carport but has a need for an additional four-bay garage spots.
Mr. Thompson stated that his wife has the two-car garage full of junk, and park under the
carport, but he has five or six cars in his driveway that need to be around the back out of
sight.
Chair Daulton questioned if he plans to gravel the driveway to the proposed garage, and
Mr. Thompson stated he would pave the driveway.
Vice Chair King questioned why the proposed garage is planned to be directly beside
the adjoining property owner.
Mr. Thompson stated that it is more convenient to pull around to go in the house.
Member Garst questioned the cost of the garage. Mr. Thompson stated that he plans to
do the work himself and it will be stick built.
Vice Chair King questioned if Mr. Thompson had considered moving the building to
another portion of his property, and he stated that he has not considered it.
Member Garst asked if Mr. Thompson would consider moving the garage. Mr. Thompson stated that it would be too much out of the way.
It was noted that accessory structures have a setback of five-foot.
Mr. Thompson stated that he plans to have the structure seven-foot off the property line.
Mike Fisher appeared before the Commission and stated that he respects Mr. Thompson
being a property owner and having a large lot. Mr. Thompson is requesting approval for a
four-bay garage and the Commission has already stated that he has a two-car garage and a
carport. He understands and appreciates Mr. Thompson being a car enthusiast, however,
nowhere in Karen Hills is there over a 1,000 square-foot detached building. There is another
car enthusiast who lives in Karen Hills currently building a three-bay garage that is
approximately 943 square feet. He stated that he does not live in the neighborhood, but his
daughter, son-in-law, and grandchildren live next door to Mr. Thompson. He stated that Mr.
Thompson's residence is 1,512 square-foot house on the upper level, and he is asking to
essentially build another house within a few feet of a fence because accessory structures
only have to be five feet from the property line. He feels that the structure will have a
negative impact on the neighborhood. The topography of Mr. Thompson's land definitely
slopes down and feels the structure is too big--the proposed driveway on the plans is 50-feet
wide, which is wider that the street in front of the house. He stated that Mr. Thompson has a
very large lot and if he would consider moving the garage to the lower left part of his
property it would have less of a negative impact--the structure is taller than a house and the
same size as a house. He further stated that his daughter and son-in-law purchased their
home a year ago, and one of the reasons they purchased the home was for the beautiful view,
which will definitely be affected with the construction of the proposed garage. He
understands he can build a 1,000 square-foot building anywhere on his property but feels if
the Planning Commission allows a 1,500 square-foot structure at the location proposed, it
will have a negative affect and will affect the view. He asked that the Commission take all of
this into consideration. Paul Daniels, 642 Joan Circle, appeared before the Commission and stated that Mr. Fisher said basically everything he planned to say. He said that he has never been in the ballpark
of telling anyone what they can and cannot do on their property--it's America, but if the structure runs lengthwise along his fence and is16-foot tall, it will have an impact on the view from his property, which is a big reason why they purchased the home.
Mr. Thompson reappeared before the Commission and stated that per the code he can
build 1,000 square-foot building but could build it two-stories tall and place a lift in the
building.
Vice Chair King stated that he could not build a two-story structure as it would be too tall.
The Zoning Administrator noted that the accessory structure could not be as tall as the
main house.
Mr. Thompson does not feel that the neighbor's view would be affected by the
proposed structure.
Vice Chair King stated that she went to the adjacent property and a property up from the
property and looked back to where she thought the structure would be and feels that the
structure would impact the view especially being that close to the property line.
Chair Daulton questioned if there was a reason why Mr. Thompson could not build a 1,000
square-foot structure.
Mr. Thompson stated that 1,000 square-foot building will not meet his needs. He stated
he would attach the structure to his house and build it as big as he wants if this is not
approved.
It was noted that an email was received by Engineering from Judy Harveycutter about
her concerns regarding the size and placement of the proposed structure. Member Garst
read the email. It was also noted that two other emails were received, but they appeared
before the Commission; and a neighbor came into the Community Development office
about the request and had no concerns.
A discussion was held regarding side-yard setback requirements for attached
structures and how it has to be attached to the primary structure.
No other person(s) appeared related to the request.
Denise King motioned to deny request of David A. Thompson, property owner, for the
issuance of a Special Exception Permit to allow a 1,500 square foot detached garage on the
property located at 640 Joan Circle (Tax Map #243-2-16). Reid Garst seconded the motion.

The owners purchased the property from the City on October 12, 2020. The current deed has several
restrictions. One of the restrictions states that the property shall be developed in substantial
conformance to the ‘Union Plaza’ conceptual development plan developed by Brushy Mountain
Engineering, PLLC, dated April 10, 2020. The original concept plan dated April 10, 2020 shows the
two buildings facing each other The owner submitted an amended concept plan dated February 8,
2023 with the buildings now being constructed side-by-side.
