Audit - Finance Committee F.Tax Rates Resolution Consider adoption of Resolution 1289, a resolution imposing taxes on real estate, tangible personal property, machinery and tools, and all legal subjects of taxation for City purposes including the property of railroad, express, telephone, telegraph, water, heat (gas) and power companies. Audit - Finance Committee G.Adoption of 2016 - 2017 Budget Consider Resolution 1292 to adopt the fiscal year 2016 - 2017 budget. Old Business A. Roanoke Valley Greenway Commission Consider Ordinance on second reading revising the Intergovemmental Agreement 2. 3. 4. 114 North 6. amending the Roanoke Valley Greenway Commission between the City of Roanoke, the County of Roanoke, the Town of Mnton, the City of Salerq to include the County of Botetourt. Passed on first reading at April 25,2016 meeting. Jane Johrson motioned approval of the Ordinance on f,rst reading revising the Intergoverffnental Agreement amending the Roanoke Valley Greenway Cornnrission between the City of Roanoke, the County of Roanoke, the Town of Vintoq the City of Salern, to include the County of Botetourt. Presentation ofAnnual Budget for20lG20l7 Hold a public hearing on the proposed annual budget for Iiscal year 2016-2017. A sunmary of the proposed budget was advertised in the Salem Times Register on April 28,2016. Ms. Jordan stated the budget was presented to City Council on March 14,2016 and the budget Work Session was held on March 28,2016. Tonight will be the public hearing as well as the first reading of the budget. The second reading will be at the May 23,2016 meeting. The bulk of the changes made were to insure the City has budgeted for the disability insurance and some regional contracts for the Regional Jail along with a couple other funding items that made a change to the general fund of $34,000. The City has received the renewal on dental irsurance and there was no increase. There are no figures available at this time for the City's health insurance at this time, but 5% has been budgeted for that. Mce-Mayor Givens asked if tbe 5% that has been budgeted is not needed if that could be added to a reserve fund for next fiscal year and Ms. Jordan confirmed it could. Mayor Foley opened the floor to the pubiic. Lisa Carroll, a retiree from the City of Salem appeared before Council asking if the City is considering bidding out the health irsurance and moving to a plan similar to the state of Mrginia's plan Ms. Jordan stated the City has not bid out the health irsurance at this time and if the City decides to they would have to get a quote from the Local Choice and there is still time to do that. Ms. Carroll asked if that is being seriously corsidered and Ms. Jordan stated that corsideration would make it B. difficult for the City to make the health insurance more affordable for both the City and employees. Ms. Carroll presented a hand out to Council. Ms. Carroll also asked if the City is still proposing a 2.5o/o tncrease for errployees and Mayor Foley confirrned that. Ms. Carroll asked why part-time errployees were included in the 2.5oh irrcrease. Mr. Jones stated it is because thev did not receive a raise the last time. Norma Dickerson of 600 High Street asked Council to seek ways to give raises every year and fund projects to enhance the working and living environment by restoring the tax rate to the way it was in the 1980s. lrslie "lrs" Eary of 2821 Simms Circle stated taxes have been raised enough and asked Council to stop increasing fees and taxes and look for ways to cut back. The public hearing was closed. \4rginia Juvenile Community Crime Control Act Consider adoption of Resolution 1286 for Participation in the Mrglnia Juvenile Comnunity Crime Control Act. Audit - Finance Committee Mce-Mayor John Givens motioned to adopt Resolution 1286 for Participation in the Mrginia Juvenile Community Crime Control Act. William Jones seconded the motion. Ayes: Foley, Givens, Joksorq Jones Absent: Chisom Mount Regis Center Consider setting bond for physical inprovements and erosion and sediment conhol for Mount Regis Center. Audit - Finance Committee Mce-Mayor John Givers motioned for approval of the bond set for physical inprovements and erosion and sediment control for Mount Regis Center. William Jones seconded the motion. Ayes: Foley, Givens, Johnson, Jones Absent: Chisom 2016 - 2017 Budget Consider ordinance on first reading to appropriate funds for the fiscal year 2016 - C. D. E. 2017 budget Audit - Finance Committee Suppiemental Item Mce-Mayor John Givens motioned to approve the ordinance on first reading to appropriate funds for the fiscal year 2016 -2017 budget. William Jones seconded the motion Ayes: Foley, Givens, Jolrsoq Jones Absent: Chisom Abstract of Votes Receive Abstract of Votes for the Municipal General Election held on May 3,2016. Supplernental Item Received Absent: Chisom Resolution 1287 Consider Resolution 1287 authorizing the City of Salem to Contract, upon conditiors to Solid Waste Transpo(ation and Disposal Services with the Roanoke Valley Resource Authority. Supplemental Item Mr. Boggess stated the proposed resolution represents a process where the City has been reviewing options of the disposal of solid waste. Currently, the trash comes to the City's Trarsfer Statio4 is loaded onto trucks that are contracted out to transport it to a landfill in Amelia County. The current contract is up for renewal and the City has been reviewing its option in relation to that. Resolution 1287 would direct us to accept the altemate bid by the Roanoke Valley Resource Authority to become a member ofthe Roanoke Valley Resource Authority and use as our solid waste disposal system after the contract award. There are some conditions as we move forward which would include a public hearing also the local charter members have to approve membership. Adoption of Resolution 1287 will begin the process. Vice-Mayor John Givers motioned to approve Resolution 1287, authorizing the City ofSalem to contract, upon conditiors, for solid waste transportation and disposal services with the Roanoke Valley Resource Authority. Jordan, Finance Director SUMMARY OF INFORMATION: The fiscal yeat 2016-2017 budget was presented to the Council on March 14, 20'16. Copies of the budget were made available to the public on the City website http://www.salemva.oov/deoartments/finance, as well as in the City library and in the City Manager's office. A public hearing was held on May 9, 20'16 to receive written and oral comment from the public concerning the budget, and the budget was presented for adoption in an earlier Council agenda item tonight. ln addition to adopting the annual budget, the local government must also appropriate the funds. A first reading of the ordinance appropriating the funds for the fiscal yeat 2016- 2017 budgetwas approved on May 9,2016. This is the second read ing of that ordinance. STAFF RECOMMENDATION: I recommend approval of the second reading of the fiscal year 2016-2017 budget appropriation ordinance. The building contains two units currently. The second unit was added at some point in the past but was never approved. When listing the property for sale it was discovered that it was non- conforming since the zoning is for single family. and WHEREAS, the Executive Secretary further reported that notice of such hearing had been published in the April 28, and May 5, 2016, issues of the SdelllMtSeglllet and WHEREAS, staff noted the following: the subject property consists of one parcel of about .2 acres located on the east side of Point Pleasant Avenue, just north ofthe intersection with East Main Street nearthe border with Roanoke City; it is currently occupied by a non-conforming two family dwelling; the second unit was added at some point in the past but was never approved; when listing the property for sale it was discovered that it was non-conforming since the zoning is for sin8le family; and the property owner is requesting the Special Exception Permit in order to make the property conform to the zoning so it can be sold as a two family dwelling; and WHEREAS, Chair Daulton noted that there was no one present to represent the petitioner; and 2 WHEREAS, Bill Maxwell, Assistant City Attorney, noted that the Commission might want to wait a few minutes and see ifthe petitioner shows up; he stated he could not remember this happening before; the Commission could send it to City Council without a recommendation; and wHEREAS, Jay Taliaferro asked if it would be in order for staffto give a report on the item, and Chair Daulton noted that this was fine with the Commission; and WHEREAS, Ben Tripp, Planner, appeared before the Commission explaining the Special Exception Permit request; he noted that the property exists as a two family dwelling now; it is an older building with two units, has two electric meters, and has operated as a duplex for some time; the second electric meter was installed in 1994, and it may well have been a two family dwelling before that; he further noted that the Zoning Administrator may have more information regarding the history of the propertyi the request is coming before the Commission because it has never been approved as a two family dwelling; the petitioner is requesting to have the structure conform to the zoning so that it can be sold; and WHEREAS, Mary Ellen Wines, Zoning Administrator, noted that the structure was built in 1940 but was not in the City of Salem at that time; it is unclear when it was converted to a two family dwelling which is why we are here today; there will not be any changes to the structure, and it will remain a two family dwelling, if approved; further, the petitioner had contacted the City for zoning verification, and this was what started the research process on the property; and WHEREAS, Commissioner King noted that the petitioner lives in Chesterfield, Virginia; she asked which side of the interstate was the wreck this evenin& she stated she wondered if he might be caught in traffic somewhere; Chair Daulton noted that the wreck was on the northbound side; and WHEREAS, Bill lMaxwell asked ifthere is any requirement that the petitioner show up for the meeting; Ben Tripp and .lay Taliaferro noted that they did not think soj Mr. Maxwell noted if that is true, then the Commission is free to act on the request and give their recommendation to City Councilbased on what has been presented; and WHEREAS, represented at the WHEREAS, property owner on there was further discussion reSarding the fact that the petitioner was not meetingj and Mary Ellen Wines noted that she spoke to the realtor first and then the a conference call together; the property owner stated he probably would not 3 be able to come but that he would have someone to appear for him because she told them someone needed to be there to represent; she did not talk to him again but he was very interested in getting this done so he could sell the property; and WHEREAS, Vice Chair Thomasson asked if it would be appropriate to deny the request and send it to City Council; Bill Maxwell noted that the Commission could recommended denial and send it to City Council, they could continue the request to check into the situation, or they could approve it; Mr. Thomasson noted that without representation, he did not feel comfortable votingi and WHEREAS, Commissioner Robertson noted that he did not know of any other concerns the Commission has regarding the request that the petitioner could help them with; he feels that the request is really pretty clear; since the Commission doer not have the final say, he would recommend approvalofthe request and let Council have the final say in the matter; several noted that this was reasonable; Jordan, Finance Director SUMMARY OF INFORMATION: Chapter 8, Section 8.3 of the City Charter requires the City Council to annually lay a tax levy for the ensuing fiscal year on all property, real and personal, subject to taxation for city purposes. State law requires a public hearing be held when the assessment increase for real estate is in excess of 1 percent or a tax rate change is proposed in real estate, personal property or machinery and tools tax. The 20'16 reassessment did not increase the tax rate by more than 1%. The tax rate is proposed to remain at $3.25 per $100 of assessed value for personal property and $3.20 per $'100 of assessed value for machinery and tools. The attached resolution shows the tax rates that are proposed for real estate, personal property and machinery and tools lax for FY 2016-2017. The School's budget is included in the overall City budget. The proposed budget was presented to the City Council onMarch14,2016. Copies ofthe proposed budget were placed in the City library and City Manager's office, and made available on the Citywebsite http://www.salemva.oov/departments/finance. The Council held a work session on the budget on March 28, 2016. A public hearing was held on lvlay g, 2016 to receive written and oral comment on the budget.
