HomeMy WebLinkAbout10/13/2014 - City Council - Minutes - RegularUNAPPROVED MINUTES CITY COUNCIL WORK SESSION October 13, 2014 A work session of the Council of the City of Salem, Virginia, was held in the City Manager’s Conference Room, 114 North Broad Street, Salem, Virginia, on October 13, 2014, at 6:30 p.m., there being present the following members of said Council, to wit: Byron Randolph Foley; John C. Givens; Jane W. Johnson, William D. Jones, Lisa D. Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S. Boggess, City Manager; James E. Taliaferro, II, Assistant City Manager and Clerk of Council; and Rosie Jordan, Director of Finance; and the following business was transacted: Mayor Foley reported that this date, place, and time had been set in order for the Council to hold a work session; and WHEREAS, a discussion was held regarding Relay for Life; and WHEREAS, a discussion was held regarding budget amendments; and WHEREAS, a discussion was held regarding duplex water rates; and WHEREAS, a discussion was held regarding Lakespring Park; and WHEREAS, there were no other topics for discussion. There being no further business to come before the Council, the work session was adjourned at 7:20p.m. ____________________________________ Mayor _____________________________________ Clerk of Council Corrected UNAPPROVED MINUTES COUNCIL MEETING October 13, 2014 A regular meeting of the Council of the City of Salem, Virginia, was held in Council Chambers, City Hall, 114 North Broad Street, on October 13, 2014, at 7:30 p.m., there being present all the members of said Council, to wit: Byron Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D. Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S. Boggess, City Manager; James E. Taliaferro, Assistant City Manager and Clerk of Council; Rosie Jordan, Director of Finance; Charles E. Van Allman, Jr., City Engineer; and Stephen M. Yost, City Attorney; and the following business was transacted: The September 22, 2014, work session and regular meeting minutes were approved as written. Mayor Foley requested that Council receive a report from Barney Horrell, Rotary Club of Salem, regarding Olde Salem Days 2014; and WHEREAS, Barney Horrell, Rotary Club of Salem, appeared before Council to give a report on Olde Salem Days 2014; THEREUPON, report was received. Mayor Foley requested that Council consider an appointment to fill the expiring term for David Preston; public hearing was held at the September 22, 2014, meeting; and WHEREAS, it was noted that David Wells withdrew his request for appointment to the School Board as Mr. Preston would like to be reappointed; and ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILMAN JONES, AND DULY CARRIED, David Preston was hereby reappointed to the Salem School Board for a three-year term, said term will expire December 31, ITEM 1 REPORT RECEIVED REGARDING 2014 OLDE SALEM DAYS ITEM 2 DAVID PRESTON REAPPOINTED TO SALEM SCHOOL BOARD 2 2017 – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council consider adopting Resolution 1258 recognizing the Livable Roanoke Valley Plan; and WHEREAS Councilwoman Garst described the Livable Roanoke Valley Plan and regional efforts to improve in four goal areas: economic development, workforce development, healthy Roanoke Valley, and natural resources; and ON MOTION MADE BY COUNCILWOMAN GARST, SECONDED BY COUNCILWOMAN JOHNSON, AND DULY CARRIED, Resolution 1258 recognizing the Livable Roanoke Valley Plan was hereby adopted – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council consider request to accept and appropriate the Flood Mitigation Assisance Grant from FEMA; and WHEREAS City Manager Kevin Boggess thanked the Engineering Department for their efforts in securing the flood grants; and WHEREAS Mayor Foley asked how many more properties are eligible for flood mitigation. The City Engineer responded that there are properties eligible for mitigation but the property must meet the requirements for a given source of grant funding; and WHEREAS Councilwoman Garst asked what the future use of the property would be. The City Engineer responded that the mitigation properties must be open space although they could be used for parking if the surface is permeable. ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILMAN JONES, AND DULY CARRIED, the Flood ITEM 4 FLOOD MITIGATION ASSISTANCE GRANT ACCEPTED AND FUNDS APPROPRIATED ITEM 3 RESOLUTION 1258 ADOPTED RECOGNIZING THE LIVABLE ROANOKE VALLEY PLAN 3 Mitigation Assistance grant was accepted and appropriated – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council consider acquiring and demolishing property as part of the severe loss program project; and ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILMAN JONES, AND DULY CARRIED, the purchase and demolition of the property at 1029 East Riverside Drive using Flood Mitigation Assistance grant funding at a cost not to exceed $65,800 was approved – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council consider setting a bond for erosion and sediment control for the Stonegate Swim Club project; and WHEREAS Vice Mayor Givens noted that this would be for the removal of two tennis courts at the swim club; and ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILMAN JONES, AND DULY CARRIED, the request for an erosion and sediment control bond in the amount of $5,477.00 with a completion time of twelve months was hereby approved – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council consider appointments to fill vacancies on various boards and commissions; and ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILMAN JONES, AND DULY CARRIED, Winston DuBois was recommended to the Circuit Court for appointment to the Board of Zoning Appeals for a term to expire ITEM 5 SEVERE REPETITIVE LOSS PROGRAM ITEM 6 EROSION AND SEDIMENT CONTROL BOND FOR STONEGATE SWIM CLUB ITEM 7 RECOMMENDED APPOINTMENT OF WINSTON DUBOIS TO THE BOARD OF ZONING APPEALS AND NANCY DUFFY AND GILL ROSEBERRY TO THE BOARD OF EQUALIZATION 4 June 5, 2019, and Nancy Duffy and Gill Roseberry were recommended to the Circuit Court for appointment to the Board of Equalization of Real Estate Assessments with terms expiring November 30, 2017 – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council hold a public hearing and consider the request of Green Gearheads, lessee, and Strauss Properties, LLC & the Branch Family LLC, property owners, for the issuance of a Special Exception Permit to allow scrap and salvage services on the property located at 1435 Lakeside Circle (Tax Map # 51-3-4). (Advertised in the February 5, and 12, 2014, issues of The Roanoke Times. Continued from the February 24, 2014, and April 14, 2014 meetings.); and WHEREAS, Mayor Foley noted that Council had received notice of withdrawal of this item by the petitioner; and WHEREAS, the City Manager noted that the recycling business would continue but the scrap and salvage use would not be pursued at this time; and WHEREAS, Council took no action on the withdrawn item. WHEREAS Councilman Jones recognized Assistant City Manager Jay Taliaferro for being elected the Chairman of the Western Virginia Regional Jail Authority; and WHEREAS Councilwoman Garst recognized the Fine Arts Commission for their efforts on Art on the Way; and Mayor Foley requested that Council consider holding a closed session for specific purposes of 2.2- 3711 A(7), consultation with legal counsel, and 2.2- 3711 A(1) personnel matter; and ITEM S1 SPECIAL EXCEPTION PERMIT FOR SCRAP AND SALVAGE FOR GREEN GEARHEADS, LLC; WITHDRAWN BY PETITIONER ITEM S2 CLOSED MEETING TO DISCUSS A PERSONNEL MATTER AND CONSULTATION WITH LEGAL COUNSEL 5 ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILWOMAN JOHNSON, AND DULY CARRIED, Council convened a closed session at 7:57 p.m. to discuss the following specific matters: 1) Consultation with legal counsel, as authorized by 2.2-3711 A(7) of the Code of Virginia, 1950 as amended to date, and 2) Personnel matter related to an appointed official, authorized by 2.2-3711 A(1) of the Code of Virginia, 1950 as amended to date, – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Upon reconvening at 8:18 p.m.; ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILWOMAN JOHNSON, AND DULY CARRIED, in accordance with Section 2.2-3712 D. of the Code of Virginia, 1950 as amended to date, Council hereby certifies that in Closed Session only items lawfully exempted from open meeting requirements under the Virginia Freedom of Information Act and only such items identified in the motion by which the Closed Session was convened were heard, discussed, or considered by the Council– the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. There being no further business to come before the Council, the same on motion adjourned at 8:19 p.m.
