CITY COUNCIL WORK SESSION
APRIL 8, 2013
A work session of the Council of the City of Salem, Virginia, was held in the City
Manager’s Conference Room, City Hall, 114 North Broad Street, Salem, Virginia, on April 8,
2013, at 6:30 p.m., there being present all the members of said Council, to wit: Byron Randolph
Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D. Garst; with Byron
Randolph Foley, Mayor, presiding; together with Kevin S. Boggess, City Manager; James E.
Taliaferro, II, Assistant City Manager and Clerk of Council; and Mary Ellen H. Wines, Deputy
Zoning Administrator/Secretary; and the following business was transacted:
Mayor Foley reported that this date, place, and time had been set in order for the
Council to hold a work session; and
WHEREAS, a discussion was held regarding opening day at the Salem Red Sox; and
WHEREAS, a discussion regarding the 9-11 historical marker was tabled until a future
work session; and
WHEREAS, the City Manager discussed the latest meeting of the Roanoke College
Neighborhood Task Force; and
WHEREAS, a discussion was held regarding property the City has been offered for
purchase; and
WHEREAS, a discussion was held regarding the upcoming Roanoke College Board of
Trustees dinner; and
WHEREAS, it was noted that the retirement party for SHS principal John Hall will be May
30, 2013, 4:00p.m. to 6:00p.m. at the Salem Civic Center.
WHEREAS, it was noted that a joint session of Salem City Council and the Salem School
Board will be held, possible date, April 30, 2013; and
WHEREAS, there were no other topics for discussion.
There being no further business to come before the Council, the work session was
adjourned at 7:01p.m.

COUNCIL MEETING
April 8, 2013
A regular meeting of the Council of the City of Salem, Virginia, was held in
Council Chambers, City Hall, 114 North Broad Street, on April 8, 2013, at
7:30 p.m., there being present all the members of said Council, to wit: Byron
Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D.
Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S.
Boggess, City Manager; James E. Taliaferro, Assistant City Manager and Clerk of
Council; Melinda J. Payne, Director of Planning and Economic Development;
Stephen M. Yost, City Attorney; Charles E. Van Allman, Jr., City Engineer; and
Mike Stevens, Communications Director; and the following business was
transacted:
The March 25, 2013, work session and regular meeting minutes were
approved as written.
It was noted that two members of Boy Scout Troop 849 were present at
the meeting.
Mayor Foley requested that Council receive a donation presentation from
the Dean of Students of Roanoke College; and
WHEREAS, Gene Zdziarski, 516 North Market Street, Roanoke College
Vice President for Student Affairs and Dean of Students, appeared before the
Council and stated that Roanoke College was founded in 1842; five years later,
the college moved to Salem, Virginia, and became Roanoke College; he stated
that the City of Salem and Roanoke College have enjoyed a partnership for 166
years; there have been existing partnerships between the College with law
enforcement units and training, backup support, the Community Relations
Taskforce was created, worked with Salem High School, worked with the city to
host a variety of athletic events throughout the community, and most recently
the creation of the Salem Wifi project; he stated that on behalf of the Board of
Trustees, President Maxey, and the students, faculty, and staff of Roanoke
College, he would like to express their gratitude to the City of Salem; the City
provides a tremendous array of services to the citizens of this community and
everyone is a beneficiary of those services; it is with extreme appreciation and
gratitude that Roanoke College would like to present a check for $25,000 to the
City of Salem; he then presented Council with the check; and

WHEREAS, Mayor Foley noted that the funds would be used for EMS
capital projects, and Parks and Recreation projects; he thanked Roanoke College
for being a great partner in the community;
THEREUPON, presentation was received.
Mayor Foley requested that Council consider adopting Resolution 122 5
commending the Salem High School Girls Basketball Team for winning the 2013
State AA, Division IV Basketball Championship; and
WHEREAS, Mayor Foley read the resolution; and
WHEREAS, Council presented each member of the team with a copy of
the resolution along with a Championship pin; and
WHEREAS, Councilman Jones commended the team on the teamwork
they displayed during the season;
ON MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY
COUNCILWOMAN GARST, AND DULY CARRIED, Resolution 1225 commending the
Salem High School Girls basketball team for winning the 2013 State AA, Division
IV Basketball Championship was hereby adopted – the roll call vote: Lisa D.
Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye,
and Byron Randolph Foley – aye.
Mayor Foley requested that Council consider adopting Resolution 1226

Mayor Foley reported that this date and time had been set to hold a
public hearing to consider the request of PEG Bandwidth VA, LLC, to authorize a
Rights-of-Way Use Agreement; notice of such hearing was published in the
March 25 and April 1, 2013, issues of The Roanoke Times, a newspaper having
general circulation in the City of Salem; and
WHEREAS, the City Manager stated that this is a “typical” agreement,
where a company wants to use the City right-of-way to provide access and
services throughout the City; he noted that the Director of the Electric
Department is also present if Council has any specific questions; and
WHEREAS, no other person(s) appeared related to the request;
ON A MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILMAN JONES, AND DULY CARRIED, a rights-of-way use agreement with
PEG Bandwidth VA, LLC, was hereby authorized – the roll call vote: Lisa D. Garst
– aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and
Byron Randolph Foley – aye.
Mayor Foley requested that Council receive report and authorize the City
Manager to execute a contract for the Extra-territorial Arrest Agreement; and
WHEREAS, the City Manager stated that this agreement allows police
officers from Roanoke City, Salem City, Roanoke County, and the Town of Vinton
to exercise extra-territorial arrest agreement; if a Town of Vinton officer is
driving on Thompson Memorial Drive to get to the Roanoke County Courthouse
and witnesses a person possibly driving under the influence or endangering
public safety, the officer will have the authority, without having to wait on a
Salem officer to arrive, to execute a traffic stop and make an arrest if necessary;
he stated that this agreement will allow the jurisdictions in the Roanoke Valley to
help each other when there is truly a public safety concern; the agreement is not
intended to allow a Roanoke City officer to set up radar in the Town of Vinton,
Roanoke County, or the City of Salem; it is intended primarily for those incidental
cases where an officer comes upon a situation in which they feel a duty to
intervene; and
WHEREAS, Councilwoman Garst stated that this agreement is a smart
public safety measure; and
WHEREAS, the City Attorney noted that the agreement will also give
officers from other jurisdictions arrest powers when they are utilized for special

events such as the Salem Fair;

COUNCILWOMAN JOHNSON, AND DULY CARRIED, the City Manager was hereby
authorized to execute a contract for the Extra-territorial Arrest Agreement – the

John C. Givens – aye, and Byron Randolph Foley – aye.
Mayor Foley requested that Council consider adoption of Resolution
1227 closing Main Street on September 14, 2013, for Olde Salem Days festivities;
and
WHEREAS, Barney Horrell, 3555 Carvins Cove Road, Salem (Roanoke
County), appeared before the Council and noted that the request is the same as
in years past--same times and same street closures; he noted that this year, a
map was included with the request and will be given to all the vendors who
participate in the event;
ON A MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY
COUNCILWOMAN GARST, AND DULY CARRIED, Resolution 1227 closing Main
Street on September 14, 2013, for Olde Salem Days festivities was hereby

Mayor Foley requested that Council receive report and authorize the City
Manager to execute a contract for the Roanoke Valley Convention and Visitors
Bureau Regional Agreement; and
WHEREAS, Landon Howard, 6123 Flamingo Drive, Roanoke, President of
the Roanoke Valley Convention and Visitors Bureau (RVCVB), appeared before
the Council to give a presentation regarding the RVCVB Regional Agreement; he
stated that Roanoke City and Roanoke County have already approved this
agreement; he noted that this started approximately two or three years ago due
to a measure from the General Assembly; he commended the staff of the City of
Salem; he stated that he feels that this agreement is a positive for all of the
localities involved in this agreement; he invited Council to take a joint photo with
the Roanoke City Council and the Roanoke County Board of Supervisors as part
of this year’s Annual Meeting; and

have been discussed at this meeting;

COUNCILWOMAN GARST, AND DULY CARRIED, the City Manager was hereby
authorized to execute a contract for the Roanoke Valley Convention and Visitors
Bureau Regional Agreement – the roll call vote: Lisa D. Garst – aye, William D.
Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph
Foley – aye.
There being no further business to come before the Council, the same on
motion adjourned at 8:09 p.m.
