CITY COUNCIL WORK SESSION
March 25, 2013
A work session of the Council of the City of Salem, Virginia, was held in the City Council’s
Conference Room, City Hall, 114 North Broad Street, Salem, Virginia, on March 25, 2013, at 6:30
p.m., there being present all the members of said Council, to wit: Byron Randolph Foley, John
C. Givens, Jane W. Johnson, William D. Jones, and Lisa D. Garst; with Byron Randolph Foley,
Mayor, presiding; together with Kevin S. Boggess, City Manager; James E. Taliaferro, II, Assistant
City Manager and Clerk of Council; Diane Hyatt, Interim Director of Finance; Mary Ellen Wines,
Deputy Zoning Administrator; and Krystal M. Farmer, Deputy Clerk of Council; and the following
business was transacted:
Mayor Foley reported that this date, place, and time had been set in order for the
Council to hold a work session; and
WHEREAS, a discussion was held regarding the Extra-territorial Arrest Agreement;; and
WHEREAS, a discussion was held regarding the Sign Ordinance; and
WHEREAS, there were no other topics for discussion.
There being no further business to come before the Council, the work session was
adjourned at 7:26 p.m.

COUNCIL MEETING
March 25, 2013
A regular meeting of the Council of the City of Salem, Virginia, was held in
Council Chambers, City Hall, 114 North Broad Street, on March 25, 2013, at
7:30 p.m., there being present all the members of said Council, to wit: Byron
Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D.
Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S.
Boggess, City Manager; James E. Taliaferro, Assistant City Manager and Clerk of
Council; Melinda J. Payne, Director of Planning and Economic Development;
Stephen M. Yost, City Attorney; Diane Hyatt, Interim Director of Finance; and
Mike Stevens, Communications Director; and the following business was
transacted:
The March 11, 2013, work session and regular meeting minutes were
approved as written.
The report by the Interim Director of Finance of the City’s financial status
for an eight-month period ending February 28, 2013, was received and ordered
filed.
Mayor Foley requested that Council consider adopting Resolution 1224
establishing the allocation percentage for personal property tax relief; and
WHEREAS, Vice Mayor Givens, Chair of Council’s Audit-Finance
Committee, reported that the Committee reviewed Resolution 1224 setting the
allocation percentage for personal property tax relief for the 2013 tax year; in
December 2005, the City adopted an ordinance enacting the Personal Property
Tax Relief Act; the City uses the PPTRA Allocation Model developed by the state
to calculate the effective reimbursement rate; the rate computed using the
model for 2013 is 62.68%; the Committee recommends adoption of Resolution
1224 setting this rate; and
WHEREAS, Mayor Foley questioned if the percentage rate has been
decreasing to where individuals are paying more; and
WHEREAS, the Interim Director of Finance stated that it has been
calculated every year since 2005; last year the percentage was 63.8; she noted
that it has been as low as 59.75% and has come back up; it is based upon the
total tax filings for that year;

ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILMAN JONES, AND DULY CARRIED, Resolution 1224 establishing the
allocation percentage for personal property tax relief was hereby adopted – the
roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye,
John C. Givens – aye, and Byron Randolph Foley – aye.
Mayor Foley requested that Council consider an ordinance on second
reading amending Chapter 82, Article I, Section 82-5(d) pertaining to personal
property tax and motor vehicle decals and Chapter 86, Article IX, Sections 86 -416
through 86-419 and 86-421 through 86-432 pertaining to License Tax for Motor
Vehicles and Carriers; ordinance passed on first reading at the March 11, 2013,
meeting;
ON A MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY
COUNCILWOMAN GARST, AND DULY CARRIED, an ordinance amending Chapter
82, Article I, Section 82-5(d) pertaining to personal property tax and motor
vehicle decals and Chapter 86, Article IX, Sections 86 -416 through 86-419 and 86-
421 through 86-432 pertaining to License Tax for Motor Vehicles and Carriers
was hereby adopted – the roll call vote: Lisa D. Garst – aye, William D. Jones –
aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley –
aye.
Mayor Foley requested that Council consider appointments to fill
vacancies on various boards and commissions;
ON A MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILWOMAN JOHNSON, AND DULY CARRIED, Joseph E. Yates and Judith
Hagadorn were hereby reappointed to the Economic Development Authority for
four-year terms, said terms will expire March 9, 2017; and David G. Brittain was
hereby reappointed to the Real Estate Tax Relief Review Board for a three-year
term, said term will expire February 14, 2016 – the roll call vote: Lisa D. Garst –
aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and
Byron Randolph Foley – aye.
ON A MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILWOMAN JOHNSON, AND DULY CARRIED, David E. Derr was
recommended to be reappointed to the Board of Zoning Appeals for a five-year
term, said term will expire March 30, 2018 – the roll call vote: Lisa D. Garst –
aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and
Byron Randolph Foley – aye.
