HomeMy WebLinkAbout5/14/2012 - City Council - Minutes - RegularUNAPPROVED MINUTES COUNCIL MEETING May 14, 2012 A regular meeting of the Council of the City of Salem, Virginia, was held in Council Chambers, City Hall, 114 North Broad Street, on May 14, 2012, at 7:30 p.m., there being present the following members of said Council, to wit: Byron Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D. Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S. Boggess, City Manager; James E. Taliaferro, II, Assistant City Manager and Clerk of Council; Frank P. Turk, Director of Finance; Melinda J. Payne, Director of Planning and Economic Development; Charles E. Van Allman, Jr., City Engineer; Mike Stevens, Communications Director; and Stephen M. Yost, City Attorney, and the following business was transacted: NOTE: DUE TO AN AUDIO MALFUNCTION, THE MINUTES WERE PREPARED WITHOUT THE USE OF A RECORDING The April 23, 2012, regular meeting and work session minutes were approved as written. Mayor Foley expressed his thanks to everyone for attending the reception honoring members of the Salem High School Forensics Team and the staff of the Laconian yearbook held at 7 p.m. prior to the council meeting; Mayor Foley began the presentations by reading Resolution 1200 commending the Salem High School Forensics team for winning the 2012 State AA Forensics Championship; ON MOTION MADE BY COUNCILWOMAN GARST, SECONDED BY COUNCILWOMAN JOHNSON, AND DULY CARRIED, Resolution 1200 honoring the members of the Salem High School Forensics Team, was hereby adopted: (HERE SET OUT RESOLUTION) – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Members of council then assembled to present members of the team a copy of the resolution and a Spartan pin; Vice Mayor Givens asked all to rise and give the Forensic Team members a standing ovation for their continued success; Mayor Foley extended further congratulations and emphasized this was the seventh consecutive championship for the Forensics Team. ITEM 1 RESOLUTION 1200 COMMENDING THE SALEM HIGH SCHOOL FORENSICS TEAM FOR WINNING THE 2012 STATE AA FORENSICS CHAMPIONSHIP 2 Mayor Foley then read the Resolution 1201 commending the Salem High School Laconian Staff on winning the 2011 Gold Crown Award; ON MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY COUNCILMAN JONES, AND DULY CARRIED, Resolution 1201 commending the Salem High School Laconian Staff on winning the 2011 Gold Crown Award was hereby adopted: (HERE SET OUT RESOLUTION) – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Members of council then assembled to present the Laconian Staff a copy of the resolution and a Spartan pin; again Vice Mayor Givens asked all to rise and give the Laconian Staff a standing ovation; and he added that not only were you successful this year, but you continue to shine year after year; council members told the students they looked forward to seeing them next year when they bring home the awards. Mayor Foley requested that Council consider adoption of Resolution 1202 authorizing the City’s participation in the Virginia Juvenile Community Crime Control Act; and WHEREAS, the City Manager stated that the Virginia Juvenile Community Crime Control Act provides ongoing allocation of funds for the city and every two years the city must approve its participation; ON MOTION MADE BY COUNCILWOMAN GARST, SECONDED BY VICE MAYOR GIVENS, AND DULY CARRIED, Resolution 1202 was adopted authorizing the City’s participation in the Virginia Juvenile Community Crime Act : (HERE SET OUT RESOLUTION) – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye; Mayor Foley presented the Abstract of Votes received from the May 1, 2012, General Election and ordered that it be filed; Mayor Foley then ITEM 4 ABSTRACT OF VOTES CAST AT THE MAY 1, 2012, GENERAL ELECTION ITEM 2 RESOLUTION 1201 COMMENDING THE SALEM HIGH SCHOOL LACONIAN STAFF ON WINNING THE 2011 GOLD CROWN AWARD ITEM 3 RESOLUTION 1202 AUTHORIZING THE CITY’S PARTICIPATION IN THE VJCCCA 3 congratulated his Council colleagues on their reelection; those reelected thanked everyone for their support; Councilwoman Garst extended special thanks to poll workers. Mayor Foley requested that Council on second reading consider renaming the Industrial Development Authority to the Economic Development Authority; and ON MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY VICE MAYOR GIVENS, AND DULY CARRIED, an ordinance changing the name of the Industrial Development Authority of the City of Salem, Virginia, to the Economic Development Authority of the City of Salem, Virginia, was hereby adopted: (HERE SET OUT ORDINANCE) – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council hold a closed session pursuant to provision of Section 2.2-3711 A. (3) and (1) of the 1950 Code of Virginia, as amended, to discuss property the City may wish to sell; ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILWOMAN JOHNSON, AND DULY CARRIED, in accordance with Section 2.2-3711 A. of the Code of Virginia, 1950 as amended to date, Council convened to Closed Session at 7:45 p.m. for the purpose of discussing the following specific matters: 1. Discussion of a real estate matter pertaining to property the City may desire to sell, which is authorized by Section 2.2-3711 A. 3. of the Code of Virginia, 1950 as amended to date; and -- the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Upon reconvening at 8:15 p.m.; ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILWOMAN GARST, AND DULY CARRIED, in accordance with Section 2.2- 3712 D. of the Code of Virginia, 1950 as amended to date, Council hereby S1 CLOSED SESSION TO DISCUSS PROPERTY THE CITY MAY WISH TO SELL ITEM 5 ORDINANCE ADOPTED CHANGING THE NAME OF THE IDA TO THE EDA 4 certifies that in Closed Session only items lawfully exempted from open meeting requirements under the Virginia Freedom of Information Act and only such items identified in the motion by which the Closed Session was convened were heard, discussed, or considered by the Council -- the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. There being no further business to come before the Council, the same on motion adjourned at 8:16 p.m.
