HomeMy WebLinkAbout7/9/2012 - City Council - Minutes - RegularUNAPPROVED MINUTES CITY COUNCIL WORK SESSION July 9, 2012 A work session of the Council of the City of Salem, Virginia, was held in the City Manager’s Conference Room, City Hall, 114 North Broad Street, Salem, Virginia, on July 9, 2012, at 6:30 p.m., there being present all the members of said Council, to wit: Byron Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D. Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S. Boggess, City Manager; James E. Taliaferro, II, Assistant City Manager and Clerk of Council; Krystal M. Coleman, Deputy Clerk of Council; and Frank P. Turk, Director of Finance; and the following business was transacted: Mayor Foley reported that this date, place, and time had been set in order for the Council to hold a work session; and WHEREAS, Chief Pat Counts and Captain Eddie Hite from the Salem Fire Department gave a briefing on the emergency response from the severe wind storm that occurred on June 29, 2012; and WHEREAS, a discussion was held regarding the annual VML meeting; and WHEREAS, there were no other topics for discussion. There being no further business to come before the Council, the work session was adjourned at 7:29 p.m. Mayor Clerk of Council UNAPPROVED MINUTES--AMENDED COUNCIL MEETING July 9, 2012 A regular meeting of the Council of the City of Salem, Virginia, was held in Council Chambers, City Hall, 114 North Broad Street, on July 9, 2012, at 7:30 p.m., there being present all the members of said Council, to wit: Byron Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D. Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S. Boggess, City Manager; James E. Taliaferro, II, Assistant City Manager and Clerk of Council; Frank P. Turk, Director of Finance; Melinda J. Payne, Director of Planning and Economic Development; Mike Stevens, Communications Director; and Stephen M. Yost, City Attorney, and the following business was transacted: NOTE: DUE TO AN AUDIO MALFUNCTION, THE MINUTES WERE PREPARED WITHOUT THE USE OF A RECORDING The June 25, 2012, work session and regular meeting minutes, and the July 2, 2012, organizational meeting minutes were approved as written. Mayor Foley requested that Council receive a presentation to commemorate the 75th anniversary of the Salem Public Library; and WHEREAS, Kenneth Sosnowski, President of the Friends of the Salem Library, appeared before the Council; he stated that this year marks the 75 th anniversary of the Salem Public Library; in 1936 the City of Salem agreed to convert the Tourist Station in Younger Park into the city’s first public library and provided $150 in support; on February 15, 1937, the library officially opened with approximately 2,000 books; the city later created a satellite location on Water Street; in 1970, the original building was razed and a new building was erected; two decades later, that building was enlarged to its current size; today the library contains over 124,000 volumes; 9,000 audio books and 11,000 DVDs; he further noted that almost 19,000 people are carrying Salem Library cards in a city of only 25,000 citizens and they logged 233,000 visits last year; he then presented members of Council 75th anniversary pins; he then thanked Council on behalf of the Friends of the Salem Library, who represent all the citizens who use the library, for its history of support; THEREUPON, said presentation was received. ITEM 1 PRESENTATION TO COMMEMORATE 75TH ANNIVERSARY OF THE SALEM PUBLIC LIBRARY 2 Mayor Foley reported that this date and time had been set to hold a public hearing to consider the sale of 0.57 acres of city-owned property located north of Dulaneys Alley (Tax Map #105-4-1.1); notice of such hearing was published in the June 25, 2012, and July 2, 2012, issues of The Roanoke Times, a newspaper having general circulation in the City of Salem; and WHEREAS, the Clerk of Council appeared before the Council and stated that it is proposed to sell/swap the city-owned 0.57 acre parcel located north of Dulaneys Alley (Tax Map #105-4-1.1) to Roanoke College for a portion of the property located at 232 North Broad Street/247 Red Lane (Tax Map #87 -7-7) owned by Roanoke College Trustees; he discussed the conditions to the proposed sale/swap; and WHEREAS, no other person(s) appeared related to the sale; ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILWOMAN JOHNSON, AND DULY CARRIED, the sale/swap of city-owned property being a 0.57 acre parcel located north of Dulaneys Alley (Tax Map #105 - 4-1.1) to Roanoke College for a portion of the property located at 232 N orth Broad Street/247 Red Lane (Tax Map #87-7-7) was here approved with the following conditions: approval of the city-owned 0.57 acre parcel being rezoned to College and University District; approval 0.38 acre portion of the Roanoke College owned property being rezoned to Residential Single Family District; the City retaining an easement on a portion of the 0.57 acre parcel for City parking; the subdivision of Tax Map #87-7-7 to create the 0.38 acre parcel; subject to legal review and acceptance of a contract for the sale/swap by the City Attorney; and installation of landscaping to be installed on the west property line to provide a buffer to the Residential Single Family District properties – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council consider adopting Resolution 1209 amending section 3.06 of the Personnel Operating Procedures pertaining to City Owned Vehicles; the resolution was continued from the June 25, 2012, meeting; ON MOTION MADE BY COUNCILMAN JONES, SECONDED BY COUNCILWOMAN GARST, AND DULY CARRIED, Resolution 1209 amending section 3.06 of the Personnel Operating Procedures pertaining to City Owned Vehicles was hereby adopted: (HERE SET OUT RESOLUTION) ITEM 2 PUBLIC HEARING FOR SALE OF CITY PROPERTY LOCATED NORTH OF DULANEYS ALLEY (T/M 105-4-1.1); SALE/SWAP APPROVED WITH ROANOKE COLLEGE WITH CONDITIONS ITEM 3 RESOLUTION 1209 ADOPTED AMENDING SECTION 3.06 OF THE P.O.P. PERTAINING TO CITY OWNED VEHICLES 3 – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council consider adopting Resolution 1211 reaffirming the declaration of local emergency declared on June 29, 2012, in the City of Salem; ON MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY VICE MAYOR GIVENS, AND DULY CARRIED, Resolution 1211 reaffirming the declaration of local emergency declared on June 29, 2012, in the City of Salem was hereby adopted: (HERE SET OUT RESOLUTION) – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – nay, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council receive report regarding year end funds as required by Government Accounting Standards Board; ON MOTION MADE BY COUNCILMAN JONES, SECONDED BY COUNCILWOMAN JOHNSON, AND DULY CARRIED, receive a report regarding year end funds as required by Government Accounting Standards Board was hereby continued to a future meeting of Council – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye; Mayor Foley requested that Council consider appointments on various boards and commissions; ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILMAN JONES, AND DULY CARRIED, Amanda Hall, Salem City Schools Supervisor of Business, was hereby appointed to the Community Policy and Management Team and the OPEB Committee – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. ITEM 4 RESOLUTION 1211 ADOPTED REAFFIRMING THE DECLARATION OF LOCAL EMERGENCY DECLARED ON JUNE 29, 2012, IN THE CITY OF SALEM ITEM 6 AMANDA HALL, SALEM CITY SCHOOLS SUPERVISOR OF BUSINESS, APPOINTED TO CPMT AND OPEB COMMITTEE ITEM 5 RECEIVE REPORT REGARDING YEAR END FUNDS AS REQUIRED BY GOVERNMENT ACCOUNTING STANDARDS BOARD CONTINUED 4 Mayor Foley requested that Council consider an ordinance on second reading regarding the the request of Elaine F. Laletas, property owner, for rezoning the property located at 914 Delaware Street (Tax Map #185-5-4) from HBD Highway Business District to RSF Residential Single Family District; the ordinance was passed on first reading at the June 25, 2012, meeting; ON MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY COUNCILMAN JONES, AND DULY CARRIED, an ordinance rezoning the property of Elaine F. Laletas located at 914 Delaware Street (Tax Map #185-5-4) from HBD Highway Business District to RSF Residential Single Family District was hereby adopted – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye.
