CITY COUNCIL WORK SESSION
June 14, 2010
A work session of the Council of the City of Salem, Virginia, was held in the City
Manager’s Conference Room, City Hall, 114 North Broad Street, Salem, Virginia, on June 14,
2010, at 6:30 p.m., there being present all the members of said Council, to wit: Byron Randolph
Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D. Garst; with Byron
Randolph Foley, Mayor, presiding; together with Kevin S. Boggess, City Manager; James E.
Taliaferro, II, Assistant City Manager and Clerk of Council; Frank P. Turk, Director of Finance;
Melinda J. Payne, Director of Planning and Economic Development; Mike Stevens,
Communications Director; and Judy L. Hough, Planner, and the following business was
transacted:
Mayor Foley reported that this date, place, and time had been set in order for the
Council to hold a work session; and
WHEREAS, a discussion was held regarding a Special Exception Permit for property
located at 521 Boulevard; and
WHEREAS, a discussion was held regarding a dog park; and
WHEREAS, a discussion was held regarding the Wilkinson property; and
WHEREAS, a discussion was held regarding VRS (Virginia Retirement System)
contribution; and
WHEREAS, there were no other topics for discussion.
There being no further business to come before the Council, the work session was
adjourned at 7:21 p.m.

June 14, 2010
A regular meeting of the Council of the City of Salem, Virginia, was held in
Council Chambers, City Hall, 114 North Broad Street, on June 14, 2010, at
7:30 p.m., there being present all the members of said Council, to wit: Byron
Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D.
Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S.
Boggess, City Manager; James E. Taliaferro, II, Assistant City Manager and Clerk
of Council; Frank P. Turk, Director of Finance; Melinda J. Payne, Director of
Planning and Economic Development; Charles E. Van Allman, Jr., City Engineer;
Mike Stevens, Communications Director; and Stephen M. Yost, City Attorney,
and the following business was transacted:
The May 24, 2010, work session and regular meeting minutes were
approved as written.
The report by the City Manager of the City’s activities for April 2010 was
received and ordered filed.
Mayor Foley requested that Council consider an ordinance on second
reading adopting the budget for fiscal year 2010-2011; the ordinance was passed
on first reading at the May 24, 2010, meeting;
ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILMAN JONES, AND DULY CARRIED, an ordinance adopting the budget for
fiscal year 2010-2011 was hereby adopted:

Mayor Foley requested that Council consider an ordinance on second
reading establishing tax rates for real estate and personal property effective July
1, 2010; the ordinance was passed on first reading at the May 24, 2010, meeting;

Mayor Foley requested that Council consider an ordinance on first
reading amending Chapter 90, Article IV, Division 2, Section 90 -257 pertaining to
water rates within the City of Salem to be effective July 1, 2010; and
WHEREAS, Vice Mayor Givens, Chairman of Council’s Audit-Finance
Committee, stated that Section 90-257, water rates, and 90-303, sewer rates, are
requested to be amended; it is a culmination of over two years effort by City
Management and staff, along with Draper Aden, the City’s consultant for the
project; he further stated that the proposed rates will move away from the
“minimum bill” method to a “base charge/volume charge system” that aids the
small user and rewards conservation; a multi-unit category has been created to
provide equity to situations where one meter serves several units; lastly, fees
have been established for individuals or businesses with availability to the
system that are not currently using the system; Council has previously reviewed
the consultant’s report that the proposed ordinances phase in the rates over
several years in order that the burden be spread equitably over time; and
WHEREAS, the City Manager stated that a public meeting was held on
June 10, 2010, to discuss the proposed water and sewer rate increases and
approximately 25 residents attended the meeting who asked questions
regarding the increases; he stated that Council is requested to approve the
proposed rate increases; the increases are necessary to address the needs of the
system and to provide the infrastructure needed by the City for its water and
sewer system; and
WHEREAS, Councilwoman Johnson stated that she was present at the
informational meeting and commended the City Manager and city staff on
presenting the information to the general public; she stated that she felt the
questions asked by the residents were satisfied with the answers given; and
WHEREAS, a discussion was held regarding the needs of the
infrastructure, mandates, rate increases, etc.;

SECTION 90-257, OF THE CODE OF THE CITY OF SALEM, VIRGINIA, PERTAINING
TO RATES WITHIN CITY” was hereby passed on first reading – the roll call vote:

Mayor Foley requested that Council consider an ordinance on first
reading amending Chapter 90, Article III, Division 3, Subdivision 1, Section 90-
74(a) pertaining to water connection charges within the City of Salem to be
effective July 1, 2010; and
WHEREAS, Vice Mayor Givens, Chairman of Council’s Audit-Finance
Committee, stated that as part of the overhaul of water and sewer revenue
streams, it is recommended that the charge for water connections be amended
as outlined in the ordinance on first reading for Section 90.74; the increases are
minimal and are intended to recoup the City’s cost in making the connections;
normally, the fees are only applicable to new construction, but on occasion,
some connections need to be moved for various reasons;
ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILWOMAN JOHNSON, AND DULY CARRIED, an ordinance entitled, “AN
ORDINANCE TO AMEND, REVISE, AND REORDAIN SECTION 90-74, SUBSECTION
(a), SUBDIVISION 1, DIVISION 3, ARTICLE III, CHAPTER 90, OF THE CODE OF THE
CITY OF SALEM, VIRGINIA, PERTAINING TO WATER CONNECTION CHARGES
GENERALLY” was hereby passed on first reading – the roll call vote: Lisa D. Garst
– aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and
Byron Randolph Foley – aye.
Mayor Foley requested that Council consider adopting Resolution 116 2
establishing various miscellaneous fees for fiscal year 2010-2011; and
WHEREAS, the Director of Finance stated that Resolution 1162 addresses
miscellaneous fees for 2010-2011; he stated that the changes are to eliminate
charges for fire meter, which are now included in the water rate ordinance;
library fees recommended are done in conjunction with the Regional Library
Program and establishes a uniform fee structure; and a change in cemetery fees
is included at Council’s request;

miscellaneous fees for fiscal year 2010-2011:

Mayor Foley requested that Council receive a report regarding
continuation of fiscal agent agreements between the City and Court Community
Corrections/VASAP and the Cardinal Criminal Justice Academy for fiscal year
2010-2011; and
WHEREAS, the Director of Finance stated that the City has been acting as
the fiscal agent for both agencies since the early 1980s; he stated that the City is
responsible for the accounting, financial reporting, and audits of the agencies are
included in the City’s audit; he further stated that the city is reimbursed for costs
plus fees associated with everything handled by the city;
ON MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY VICE
MAYOR GIVENS, AND DULY CARRIED, the continuation of fiscal agent
agreements between the City and Court Community Corrections/VASAP and the
Cardinal Criminal Justice Academy for fiscal year 2010-2011 were hereby
approved and the proper city officials are hereby authorized to execute the
contracts – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W.
Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye.
Mayor Foley requested that Council consider appointments to fill
vacancies on various boards and commissions;
ON MOTION MADE BY COUNCILMAN JONES, SECONDED BY
COUNCILWOMAN JOHNSON, AND DULY CARRIED, John C. Givens was hereby
reappointed to the Virginia’s First Regional Industrial Facility Authority for a four-
year term, said term will expire June 30, 2014 – the roll call vote: Lisa D. Garst –
aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and
Byron Randolph Foley – aye.
There being no further business to come before the Council, the same on
motion adjourned at 7:50 p.m.
