HomeMy WebLinkAbout2/8/2010 - City Council - Minutes - RegularUNAPPROVED MINUTES COUNCIL MEETING February 8, 2010 A regular meeting of the Council of the City of Salem, Virginia, was held in Council Chambers, City Hall, 114 North Broad Street, on February 8, 2010, at 7:30 p.m., there being present all the members of said Council, to wit: Byron Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D. Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S. Boggess, City Manager; James E. Taliaferro, II, Assistant City Manager and Clerk of Council; Frank P. Turk, Director of Finance; Melinda J. Payne, Director of Planning and Economic Development; Charles E. Van Allman, Jr., City Engineer; Mike Stevens, Communications Director; and Stephen M. Yost, City Attorney; and the following business was transacted: The January 25, 2010, work session and regular meeting minutes and the minutes of the February 3, 2010, special meeting minutes were approved as written. Mayor Foley reported that this date and time had been set to hold a public hearing to consider the request of H-H of VA, LLC, property owner, and CommUNITY Church, lessee, for rezoning the property located at 901 Russell Drive (Tax Map 15-1-1) from BCD Business Commerce District to RSF Residential Single Family District; request was continued from the January 11, 2010, meeting; and WHEREAS, the City Attorney stated that after consultation with the petitioner and their legal counsel, it is requested that the item be continued until the first meeting in May (May 10, 2010) in order to provide an opportunity for the arrangement to be completed; he stated that he expects the item to be removed from the agenda at the May 10, 2010, meeting; ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILMAN JONES, AND DULY CARRIED, the request of H-H of VA, LLC, property owner, and CommUNITY Church, lessee, for rezoning the property located at 901 Russell Drive (Tax Map 15-1-1) from BCD Business Commerce District to RSF Residential Single Family District was hereby continued until May 10, 2010 – the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council consider an ordinance on second reading amending Chapter 14, Article I in General, and Article IV Dogs and Cats, ITEM 2 ORDINANCE ADOPTED AMENDING CHAPTER 14, ARTICLE I IN GENERAL, AND ARTICLE IV DOGS AND CATS, OF THE CODE OF THE CITY OF SALEM, VIRGINIA PERTAINING TO ANIMALS ITEM 1 CONTINUED TO MAY 10, 2010, MEETING 2 of The Code of the City of Salem, Virginia, pertaining to Animals; ordinance was passed on first reading at the January 25, 2010, meeting; ON MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY COUNCILWOMAN GARST, AND DULY CARRIED, an ordinance entitled “AN ORDINANCE TO AMEND, REVISE, AND REORDAIN CHAPTER 14, ARTICLE I IN GENERAL AND ARTICLE IV DOGS AND CATS OF THE CODE OF THE CITY OF SALEM, VIRGINIA, PERTAINING TO ANIMALS,” was hereby adopted: (HERE SET OUT ORDINANCE) -- the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council consider an ordinance on second reading amending Chapter 14, Article IV Dogs and Cats, Division 2, of The Code of the City of Salem, Virginia, pertaining to Animals; ON MOTION MADE BY COUNCILMAN JONES, SECONDED BY COUNCILWOMAN GARST, AND DULY CARRIED, an ordinance entitled “AN ORDINANCE TO AMEND, REVISE, AND REORDAIN CHAPTER 14, ARTICLE IV DOGS AND CATS, DIVISION 2 OF THE CODE OF THE CITY OF SALEM, VIRGINIA, PERTAINING TO ANIMALS,” was hereby adopted: (HERE SET OUT ORDINANCE) -- the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Mayor Foley requested that Council consider adopting Resolution 1151 in support of the formation of the Complete Count Committee for the 2010 Census; and WHEREAS, Linda Edwards-White, Partnership Specialist with the U. S. Census Bureau, appeared before the Council to talk about the 2010 Census; she stated that the count is fast approaching and the forms will be mailed out between March 15-17, 2010, so that people can complete the form and mail it back by April 1, 2010; she stated that the Census Bureau has determined that 7 out of 10 people who receive the form actually complete the form and mail it back, but 3 out of 10 people do not; she stated that the people who do not ITEM 3 ORDINANCE ADOPTED AMENDING CHAPTER 14, ARTICLE IV DOGS AND CATS, OF THE CODE OF THE CITY OF SALEM, VIRGINIA, PERTAINING TO ANIMALS ITEM S1 RESOLUTION 1151 APPROVED IN SUPPORT OF THE FORMATION OF THE COMPLETE COUNT COMMITTEE FOR THE 2010 CENSUS 3 complete the forms are the “hard to count” population; she further stated that it is important for everyone to be counted for two reasons: 1) over $400 billion will be allocated every year for the next 10 years by the federal government and are based on the 2010 Census Count, and 2) in 2011 the 2010 Census Count will be used for reapportionment and the drawing of district lines; she stated that the hard to count people will be renters, the elderly, and young people between the ages of 17 and 24 who are not married or in school, and African American males between the ages of 17 and 44; she asked that Council consider having a Complete Count Committee who would be trusted voices in the community, and who can target specific areas where people live who do not respond in order to increase the response rate; she further stated that a Census has been done every 10 years since 1790 and will continue to be done every 10 years as long as the Constitution requires for it to be done; she asked Council to help Salem increase its response rate and encouraged everyone to fill out and return the form by April 1, 2010; and WHEREAS, a discussion was held regarding ways to get the word out to encourage people to return the Census forms; and WHEREAS, the Director of Planning stated that the Census Bureau has been working closely with the Planning and Engineering Departments in order to get the information out to everyone; she stated that a Complete Count Committee has been assembled and will undergo training before going out to make presentations to people and groups so that they are aware of how important it is to be have a complete count for the Census and that it is safe and easy to reply; and WHEREAS, Ms. Edwards-White stated that only U. S. Census workers will be conducting the Census; and WHEREAS, a discussion was held regarding the Census—why people are unsure about responding; what information is released, etc.; ON MOTION MADE BY COUNCILWOMAN GARST, SECONDED BY COUNCILWOMAN JOHNSON, AND DULY CARRIED, Resolution 1151 in support of the formation of the Complete Count Committee for the 2010 Census was hereby adopted: (HERE SET OUT RESOLUTION 1151) -- the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. 4 Mayor Foley requested that Council consider adopting Resolution 1152 authorizing the City’s participation in the Virginia Juvenile Community Crime Control Act; and WHEREAS, the Director of Finance appeared before the Council and stated that the City shares a grant with the County of Roanoke for funding for a position (one for Salem, one for Roanoke County) to be used the youth in Juvenile and Domestic Relations Court; she stated that the individual spends the majority of the time working with the court system with children who have been in trouble in the courts; he stated that the City of Salem has been approved for one full-time position which is 100 percent funded by the Commonwealth of Virginia; he further stated that in order to be included and recei ve money in the 2011-12 biennium, a resolution has to be adopted authorizing the City’s participation; ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILMAN JONES, AND DULY CARRIED, Resolution 1152 authorizing the City’s participation in the Virginia Juvenile Community Crime Control Act was hereby adopted: (HERE SET OUT RESOLUTION 1152) -- the roll call vote: Lisa D. Garst – aye, William D. Jones – aye, Jane W. Johnson – aye, John C. Givens – aye, and Byron Randolph Foley – aye. Council commended the City Attorney and his staff for all their hard work in connection with the rezoning request from CommUNITY Church.
