HomeMy WebLinkAbout5/11/2009 - City Council - Minutes - RegularUNAPPROVED MINUTES CITY COUNCIL WORK SESSION May 11, 2009 A work session of the Council of the City of Salem, Virginia, was held in the City Manager’s Conference Room, City Hall, 114 North Broad Street, Salem, Virginia, on May 11, 2009, at 6:30 p.m., there being present all the members of said Council, to wit: Byron Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D. Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S. Boggess, City Manager; James E. Taliaferro, II, Assistant City Manager and Clerk of Council; and Frank P. Turk, Director of Finance; and the following business was transacted: Mayor Foley reported that this date, place, and time had been set in order for the Council to hold a work session; and WHEREAS, a presentation from Rhonda Hale, Salem Fine Arts Commission, regarding an update on the Fine Arts Commission; and WHEREAS, Salem Police Chief James R. Bryant asked that the bridge over the Roanoke River on Colorado Street be dedicated to Russell McCurrey, a Salem Police Officer killed in the line of duty on February 29, 1976; and WHEREAS, there were no other topics for discussion. There being no further business to come before the Council, the work session was adjourned at 7:15 p.m. Mayor Clerk of Council UNAPPROVED MINUTES COUNCIL MEETING May 11, 2009 A regular meeting of the Council of the City of Salem, Virginia, was held in the Council Chambers, City Hall, 114 North Broad Street, on May 11, 2009, at 7:30 p.m., there being present all the members of said Council, to wit: Byron Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D. Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S. Boggess, City Manager; James E. Taliaferro, II, Assistant City Manager and Clerk of Council; Frank P. Turk, Director of Finance; Melinda J. Payne, Director of Planning and Economic Development; Charles E. Van Allman, City Engineer; Mike Stevens, Communications Director; and Stephen M. Yost, City Attorney; and the following business was transacted: The minutes of the April 27, 2009, regular meeting of Council were approved as written. The report by the Director of Finance of the City’s financial status for a nine-month period ending March 31, 2009, was received and ordered filed. Mayor Foley reported that Council at its regular meeting held April 27, 2009, passed an ordinance on first reading rezoning the properties of Allen C. Boley and Boley Properties LLC, property owners, located at 115 and 123 Fort Lewis Boulevard (Tax Map #’s 137-4-9.3 and 137-4-9) from HBD Highway Business District to RSF Residential Single Family District; ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILMAN JONES, AND DULY CARRIED, an ordinance rezoning the properties of Allen C. Boley and Boley Properties LLC, property owners, located at 115 and 123 Fort Lewis Boulevard (Tax Map #’s 137-4-9.3 and 137-4-9) from HBD Highway Business District to RSF Residential Single Family District was hereby adopted – the roll call vote: all – aye. Mayor Foley reported that Council at its regular meeting held April 27, 2009, passed an ordinance on first reading amending Chapter 98, Division 4, Section 98-151 of The Code of the City of Salem, Virginia, pertaining to taxicab rates; ON MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY COUNCILWOMAN GARST, AND DULY CARRIED, an ordinance to amend Chapter 98, Division 4, Section 98-151 of The Code of the City of Salem, Virginia, ITEM 1 ORDINANCE ADOPTED REZONING THE PROPERTIES OF ALLEN C. BOLEY AND BOLEY PROPERTIES, LLC, LOCATED AT 115 AND 123 FORT LEWIS BOULEVARD (TAX MAP #’s 137-4-9.3 & 137-4-9) FROM HBD TO RSF ITEM 2 ORDINANCE ADOPTED AMENDING CHAPTER 98, DIVISION 4, SECTION 98-151 OF THE CODE OF THE CITY OF SALEM, VIRGINIA, PERTAINING TO TAXICAB RATES 2 pertaining to taxicab rates was hereby adopted – the roll call vote: all – aye. Mayor Foley requested that Council consider adopting Resolution 113 7 establishing a family violence fatality review team in conjunction with other localities in the Roanoke Valley; and WHEREAS, the City Attorney stated that several years ago the General Assembly enacted several sections in the Virginia Code with the idea for a jurisdiction on its own or in conjunction with other adjoining jurisdictions can form these “teams” made up of professional individuals, law enforcement individuals, court individuals, social services, psychiatrists, psychologists, etc. so that when there is a tragedy such as a family violence fatality, it is worth studying; by studying various circumstances that arose, ideas and programs can be developed that may not have been thought of before studying the incident; he stated that there has been a working group among four local jurisdictions (Salem, Roanoke County, Roanoke City, and the Town of Vinton) that have met; our Commonwealth Attorney’s office and our police department have been involved in the preliminary meetings and the Chief of Police heartily recommends involvement in this team; he further stated that other jurisdictions, if it hasn’t been done already, will also be presenting similar resolutions to its governing bodies; he stated that at some point, once the team has been organized, Council will need to make certain appointments that fit the criteria set forth in the statute on the type of professionals to be appointed to the team; he further stated that the information given to the members of the team is not subject to the Virginia Freedom of Information Act ; and WHEREAS, Vice Mayor Givens questioned how many members from each locality would be a part of the team; and WHEREAS, the City Attorney stated that it has not been determined the number from each locality; he stated that it depends on how many of the local jurisdictions want to become involved; if all four jurisdictions want to be involved, he assumes that it would be a lesser number per jurisdiction than if only two jurisdictions wanted to participate; and WHEREAS, Mayor Foley questioned when the team would become involved in a situation; and WHEREAS, the City Attorney stated that he feels that the team would become involved any time after the fatality; ITEM 3 RESOLUTION 1137 ADOPTED ESTABLISHING A FAMILY VIOLENCE FATALITY REVIEW TEAM IN CONJUNCTION WITH OTHER LOCALITIES IN THE ROANOKE VALLEY 3 ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILWOMAN JOHNSON, AND DULY CARRIED, Resolution 1137 establishing a family violence fatality review team in conjunction with other localities in the Roanoke Valley was hereby adopted: (HERE SET OUT RESOLUTION 1137) – the roll call vote: all – aye. Mayor Foley requested that Council consider appointments to fill various boards and commissions; ON MOTION MADE BY COUNCILMAN JONES, SECONDED BY VICE MAYOR GIVENS, AND DULY CARRIED, William R. Shepherd was hereby reappointed to the Personnel Board for a two-year term, said term will expire June 9, 2011; John C. Givens and Jane W. Johnson were hereby reappointed to the Roanoke Valley - Alleghany Regional Commission for three-year terms, said terms will expire June 30, 2012 – the roll call vote: all – aye. ON MOTION MADE BY COUNCILWOMAN GARST, SECONDED BY VICE MAYOR GIVENS, AND DULY CARRIED, Vicki Daulton and Hamp Maxwell were hereby reappointed to the Fine Arts Commission for four-year terms, said terms will expire October 26, 2012 – the roll call vote: all – aye. Mayor Foley requested that Council consider the request of the City Manager to hold a closed session pursuant to provisions of Section 2.2-3711 A(3) of the 1950 Code of Virginia, as amended, to discuss property the City may wish to purchase; ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILWOMAN JOHNSON, AND DULY CARRIED, in accordance with Section 2.2-3711 A. of the Code of Virginia, 1950 as amended to date, Council convened to Closed Session at 7:42 p.m. for the purpose of discussing the following specific matter: 1. Discussion of a real estate matter pertaining to property the City may desire to purchase, which is authorized by Section 2.2-3711 A. 3. of the Code of Virginia, 1950 as amended to date; -- the roll call vote: all aye. ITEM 4 WILLIAM R. SHEPHERD REAPPOINTED TO PERSONNEL BOARD, JOHN C. GIVENS & JANE W. JOHNSON REAPPOINTED TO ROANOKE VALLEY- ALLEGHANY REGIONAL COMMISSION; VICKI DAULTON AND HAMP MAXWELL REAPPOINTED TO FINE ARTS COMMISSION ITEM 5 CLOSED SESSION 4 Upon reconvening at 8:09 p.m.; ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY COUNCILWOMAN JOHNSON, AND DULY CARRIED, in accordance with Section 2.2-3712 D. of the Code of Virginia, 1950 as amended to date, Council hereby certifies that in Closed Session only items lawfully exempted from open meeting requirements under the Virginia Freedom of Information Act and only such items identified in the motion by which the Closed Session was convened were heard, discussed, or considered by the Council -- the roll call vote: all - aye. There being no further business to come before the Council, the same on motion adjourned at 8:10 p.m.
