CITY COUNCIL WORK SESSION
February 9, 2009
A work session of the Council of the City of Salem, Virginia, was held in the City
Manager’s Conference Room, City Hall, 114 North Broad Street, Salem, Virginia, on February 9,
2009, at 6:00 p.m., there being present all the members of said Council, to wit: Byron Randolph
Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D. Garst; with Byron
Randolph Foley, Mayor, presiding; together with Kevin S. Boggess, City Manager; James E.
Taliaferro, II, Assistant City Manager and Clerk of Council; Melvin B. Doughty, Director of Water
and Sewer; R. Carey Harveycutter, Director of Civic Facilities; and John P. Shaner, Director of
Parks and Recreation; and the following business was transacted:
Mayor Foley reported that this date, place, and time had been set in order for the
Council to hold a work session; and
WHEREAS, R. Carey Harverycutter, Director of Civic Facilities, and Dave Kjolhede with
the Roanoke Valley Convention and Visitors Bureau gave a presentation to Council; and
WHEREAS, Melvin Doughty, Director of Water and Sewer, gave a presentation to Council
regarding the Water and Sewer Department; and
WHEREAS, John P. Shaner, Director of Parks and Recreation, gave a presentation to
Council regarding the Parks and Recreation Department; and
WHEREAS, a discussion was held regarding appointments to the Roanoke Valley
Greenway Commission;
WHEREAS, there were no other topics for discussion.
There being no further business to come before the Council, the work session was
adjourned at 7:25 p.m.

COUNCIL MEETING
February 9, 2009
A regular meeting of the Council of the City of Salem, Virginia, was held in
the Council Chambers, City Hall, 114 North Broad Street, on February 9, 2009, at
7:30 p.m., there being present all the members of said Council, to wit: Byron
Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D.
Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S.
Boggess, City Manager; Krystal M. Coleman, Deputy Clerk of Council; Frank P.
Turk, Director of Finance; Melinda J. Payne, Director of Planning and Economic
Development; Charles E. Van Allman, Jr., City Engineer; Mike Stevens,
Communications Director; and Stephen M. Yost, City Attorney; and the following
business was transacted:
The minutes of the January 26, 2009, work session and regular meeting of
Council were approved as written.
The report by the City Manager of the City’s activities for December 2008
was received and ordered filed.
Mayor Foley requested that Council receive a presentation from Melvin
and Becky Crowder, Co-chairs, Salem Relay for Life; and
WHEREAS, Melvin Crowder, Co-chair, Salem Relay for Life, appeared
before the Council and introduced Kat Flannery, Community Manager, American
Cancer Society; Becky Crowder; and Dee King, former co-chair for Salem Relay
for Life; Mr. Crowder also recognized Dr. Alan Seibert as honorary co -chair for
the 2009 Salem Relay for Life; he stated that Dr. Seibert could not come to the
meeting this evening; he stated that they were at this meeting to present
Council, employees, and the citizens of Salem a National Award; he stated that
the award comes from the efforts of the 2008 Salem Relay for Life and the 2008
Roanoke College Relay for Life; he further stated that the volunteers from the
two events helped the American Cancer Society raise $8.51 per capita, which
was seventh in the nation; he stated that the money raised goes to support
cancer research, education, advocacy, and patient services; he stated that the
employees of the City of Salem and the City of Salem School System who
volunteer their time to the event, help make the Salem Relay for Life the success
it has been since it began in Salem nine years ago; he further thanked the
volunteers, City Council, and the City of Salem for all their help; he then
presented Council with the Nationwide Top Ten Per Capita Award from the
American Cancer Society;

THEREUPON, said presentation was received.
Mayor Foley requested that Council receive a presentation from Beth
Doughty, Executive Director, Roanoke Regional Partnership, regarding the 2008
Annual Report; and
WHEREAS, Beth Doughty, Executive Director, Roanoke Regional
Partnership, appeared before the Council and stated that the Partnership has
accomplished a lot over the past year; she stated that for more than 25 years,
the Partnership has focused on attracting businesses to the Roanoke Valley; she
stated that 40 percent of the efforts of the Partnership is still on business
attraction, but the program of work has been expanded to help bring an
awareness of the amenities the Roanoke Valley offers to help attract new
residents, as well as businesses; she further stated that the Partnership
substantially dealt with 158 companies, and 20 percent of the prospect traffic
went to Salem; she introduced colleague Rob Ledger, Director of Business
Development, who works directly with Melinda Payne and Judy Hough in the
Planning and Economic Development office; she further stated that the
Partnership’s web site has been redone and is a 360 degree presentation of the
Roanoke Valley; the website now addresses living and working in the Valley, as
well as more detailed information for businesses wanting to locate/relocate to
the area; she discussed the various features available on the Partnership’s
website, and the various websites the Partnership uses to get information out
about the Roanoke Valley (i.e. Face Book, You Tube, etc.); she further stated that
the Partnership has worked with a consultant, a nationally known retail expert,
who has helped the Partnership “craft” the Valley’s story in order to entice retail
businesses to the area; she stated that the Partnership is also promoting the
outdoor activities available in the Valley; she introduced Pete Eshelman, Director
Outdoor Branding; she discussed the various ways the Partnership promotes the
outdoor activities for the Greater Roanoke Region, and helps promote the
businesses associated with outdoor activities; she stated that the Partnership
has been busy the past year; she thanked Council for its support and
participation in the Roanoke Regional Partnership; and
WHEREAS, Councilwoman Garst questioned the type of feedback being
received from the business prospects; and
WHEREAS, Rob Ledger stated that this is a challenging time; therefore,
the prospects are becoming fewer and fewer; he stated that the prospects that
do look at the area, want to “strike” very fast so they want to have buildings and
sites already prepared, and they want as many incentives as possible; he stated

that prospects are coming, but are hesitant to sign and are being very cautious;
THEREUPON, said presentation was received.
Mayor Foley reported that Council at its regular meeting held January 26,
2009, passed an ordinance on first reading rezoning the property of Barker
Garden Apartments LLC, property owner, located at 1139 Easton Road (Tax Map
#230-3-10) from RSF Residential Single Family District to RMF Residential Multi-
Family District;
ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILWOMAN GARST, AND DULY CARRIED, an ordinance rezoning the
property of Barker Garden Apartments LLC, property owner, located at 1139
Easton Road (Tax Map #230-3-10) from RSF Residential Single Family District to
RMF Residential Multi-Family District was hereby adopted:

Mayor Foley requested that Council consider setting bond for erosion
and sediment control for the Shiloh Baptist Church project ; and
WHEREAS, Vice Mayor Givens, Chairman of Council’s Audit-Finance
Committee, stated that the Committee reviewed the performance bond for
erosion and sediment control for the Shiloh Baptist Church project and
recommended setting bond at $11,328.00 with a time limit of twelve (12)
months for completion;
ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILWOMAN JOHNSON, AND DULY CARRIED, bond for erosion and
sediment control for the Shiloh Baptist Church project was hereby set at
$11,328.00 with a time limit of twelve (12) months for completion – the roll call
vote: all – aye.
Mayor Foley requested that Council consider setting bond for erosion
and sediment control for the First Baptist Church project; and

WHEREAS, Vice Mayor Givens, Chairman of Council’s Audit-Finance
Committee, stated that the Committee reviewed the performance bond for
erosion and sediment control for the First Baptist Church project and
recommended setting bond at $27,342.76 with a time limit of twelve (12)
months for completion;
ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILWOMAN GARST, AND DULY CARRIED, bond for erosion and sediment
control for the First Baptist Church project was hereby set at $27,342.76 with a
time limit of twelve (12) months for completion – the roll call vote: all – aye.
Mayor Foley requested that Council consider setting bond for erosion
and sediment control for the Carey Avenue Subdivision project; and
WHEREAS, Vice Mayor Givens, Chairman of Council’s Audit-Finance
Committee, stated that the Committee reviewed the performance bond for
erosion and sediment control for the Carey Avenue Subdivision project and
recommended setting bond at $24,058.00 with a time limit of twelve (12)
months for completion;
ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILMAN JONES, AND DULY CARRIED, bond for erosion and sediment
control for the Carey Avenue Subdivision project was hereby set at $24,058.00
with a time limit of twelve (12) months for completion – the roll call vote: all –
aye.
Mayor Foley requested that Council consider setting bond for erosion
and sediment control for the Invision Eye Fitness and Fashion project; and
WHEREAS, Vice Mayor Givens, Chairman of Council’s Audit-Finance
Committee, stated that the Committee reviewed the performance bond for
erosion and sediment control for the Invision Eye Fitness and Fashion project
and recommended setting bond at $33,270.00 with a time limit of twelve (12)
months for completion;
ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILWOMAN JOHNSON, AND DULY CARRIED, bond for erosion and
sediment control for the Invision Eye Fitness and Fashion project was hereby set
at $33,270.00 with a time limit of twelve (12) months for completion – the roll
call vote: all – aye.

Mayor Foley requested that Council consider setting a public hearing in
accordance with Section 98-94 of The Code of the City of Salem, Virginia, for the
issuance of Certificates of Public Convenience and Necessity for the next twelve
(12) months;
ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILMAN JONES, AND DULY CARRIED, a public hearing for the issuance of
Certificates of Public Convenience and Necessity for the next twelve (12) months
was hereby set to be held March 9, 2009 – the roll call vote: all – aye.
Mayor Foley requested that Council consider appointments to fill
vacancies on various boards and commissions;
ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILMAN JONES, AND DULY CARRIED, John P. Shaner was hereby
reappointed to the League of Older Americans for a two-year term, said term
expires March 1, 2012; and Lisa D. Garst was hereby appointed to the Roanoke
Valley Greenway Commission as a staff representative – the roll call vote: all –
aye.
There being no further business to come before the Council, the same on
motion adjourned at 8:03 p.m.
