COUNCIL MEETING
January 12, 2009
A regular meeting of the Council of the City of Salem, Virginia, was held in
the Council Chambers, City Hall, 114 North Broad Street, on January 12, 2009, at
7:35 p.m., there being present all the members of said Council, to wit: Byron
Randolph Foley, John C. Givens, Jane W. Johnson, William D. Jones, and Lisa D.
Garst; with Byron Randolph Foley, Mayor, presiding; together with Kevin S.
Boggess, City Manager; James E. Taliaferro, II, Assistant City Manager and Clerk
of Council; Frank P. Turk, Director of Finance; Mike Stevens, Communications
Director, and Stephen M. Yost, City Attorney; and the following business was
transacted:
The minutes of the December 8, 2008, work session, the December 8,
2008, regular meeting, and the December 15, 2008, special meeting of Council
were approved as written.
The report by the Director of Finance of the City’s financial status for a
five-month period ending November 30, 2008, was received and ordered filed.
Mayor Foley reported that Council at its regular meeting held December
8, 2008, passed an ordinance on first reading designating the real property of the
Adult Care Center of Roanoke Valley, Inc., located at 2321 Roanoke Boulevard
(Tax Map #225-2-6) as exempt from taxation, as used for charitable and
benevolent purposes, in accordance with Section 58.1-3651 of the Code of
Virginia;
ON MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY
COUNCILWOMAN GARST, AND DULY CARRIED, an ordinance entitled, “AN
ORDINANCE GRANTING EXEMPTION FROM REAL PROPERTY TAXATION
PURSUANT TO CODE OF VIRGINIA SECTION 58.1-3651 TO THE ADULT CARE
CENTER OF ROANOKE VALLEY, INC., A VIRGINIA NON-PROFIT CORPORATION,”
was hereby adopted:

Mayor Foley reported that Council at its regular meeting held December
8, 2008, passed an ordinance revising the Intergovernmental Agreement
establishing the Roanoke Valley Greenway Commission between the City of

ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILMAN JONES, AND DULY CARRIED, an ordinance entitled, “AN
ORDINANCE APPROVING THE REVISION TO THE INTERGOVERNMENTAL
AGREEMENT ESTABLISHING THE ROANOKE VALLEY GREENWAY COMMISSION
BETWEEN THE CITY OF ROANOKE, CITY OF SALEM, COUNTY OF ROANOKE, AND
TOWN OF VINTON,” was hereby adopted

Mayor Foley reported that the request to allow J. & A., Inc., dba Fast
Signs to bid on any contract of the City has been withdrawn;
THEREUPON, said request was withdrawn without prejudice.
Mayor Foley reported that the request to allow Sterling Engineering
Solutions, Inc. to bid on any contract of the City has been withdrawn;
THEREUPON, said request was withdrawn without prejudice.
Mayor Foley requested that Council consider appointments to fill
vacancies on various boards and commissions;
ON MOTION MADE BY VICE MAYOR GIVENS, SECONDED BY
COUNCILWOMAN JOHNSON, AND DULY CARRIED, Sally Logan Walker was
hereby appointed to the Social Services Advisory Board for a three-year term,
said term expires December 1, 2011; Melvin H. Lutz was hereby appointed to the
Board of Zoning Appeals as an alternate member to fill the unexpired term of
Norman Jackson Beamer, III, said term expires October 12, 2013; and Norman
Jackson Beamer, III, was hereby appointed to the Board of Equalization of Real
Estate Assessments to fill the unexpired term of Andrew F. Hoback, said term
expires November 30, 2009 – the roll call vote: all – aye.
There being no further business to come before the Council, the same on
motion adjourned at 7:35 p.m.
