Turk, Mayor, James W. Wallace, III, Vice-Mayor, Council members: Byron Randolph Foley, William D. Jones, and John E. Saunders; with Renee F. Turk, Mayor, presiding; together with James E. Taliaferro, II, City Manager; Rob Light, Assistant City Manager andClerk of Council; Rosemarie B. Jordan, Director of Finance; Charles E. VanAllman, Jr., Community Development Director; Mike Stevens, Communications Director; and Crystal L. Accepted 4.Old Business 5.New Business A.Salem City School Board Hold a public hearing and receive views of citizens and candidates regarding the appointment to fill the expiring term for David Preston (as advertised in the October 1, 2020, issue of the Salem Times Register.) Item # 3ADate: October 26, 2020 Mayor Turk opened the public hearing and asked for the candidates to come forward who would like to speak on this matter. David Preston, 1511 Ashley D rive, Salem appeared before C ouncil and stated he was seeking reappointment to the Salem C ity School Board. Salem is not just a place where he calls home. He was born and raised in Salem. He discussed several experiences from his time in Salem schools. He further commented on some of the challenges, achievements and goals for Salem C ity Schools. He stated that he has served on the Board for the past 12 years and is proud to be a part of a Board that focuses on our children and getting the best education possible for our children. He looks forward to meeting the current challenges while seeing great results continue. He noted that working with C ity C ouncil has never been more important to ensure that the Salem C ity Division honors it mission to love, engage and inspire every student to meet his or her full potential. He thanked C ity Council for the opportunity to serve the C ity of Salem. Mayor Turk noted the C ity of Salem and Council appreciate Mr. Preston's hard work, dedication and commitment to Salem C ity Schools. She thanked him for his comments. J oshua Kier, 209 Emmett Avenue, Salem, appeared before C ouncil asking for consideration to become a member of the school board. He noted that he could speak in agreement and disagreement with everything that Mr. Preston had said; however, he has in the past shared data from the State, but he does not feel that tonight is the time or the place. He stated he would be more than happy to share that data if they wanted it. As some of C ouncil may know, he is a teacher, and he has spent the better part of the last three years trying to find a way to serve his C ity on a teacher's schedule and that has proved difficult. He stated the citizens of Salem have shown a desire for leadership change as was demonstrated by the recent C ouncil election. He believes this implies a general frustration by the voters about the current state of our city, and since C ouncil appoints the school board members, he thinks they should seek to reflect the voters of our C ity by seeking new faces for the board. He further discussed the reasons why he should be considered for the Salem School Board. He thanked C ity Council for the opportunity to speak. Mayor Turk thanked Mr. Kier for his comments. Mayor Turk noted there was a third candidate for the Board who was unable to attend due to health reasons. T hat candidate is Robin Ott. T he C lerk of Council read the following comments into the record from Robin Ott: Good evening Mayor Turk, Vice Mayor Wallace, Mr. J ones, Mr. Saunders, and Mr. Foley. T hank you so much for having me this evening and for taking the time to listen to my thoughts about why I want to run for the Salem City School Board. Tonight, I am going to share with you a little bit about my personal and professional experiences and how they connect with my desire to serve in this capacity as a school board representative. In my life, I have three main titles: mom, engineer, and professor. First and foremost, I am a mom to two amazing kids (well they’re young adults now). My son and daughter are both Salem High School graduates. When they were young, I made a conscious decision to move to Salem specifically because they had the best schools in the area, and I wanted what was best for my children. I am known to be a fierce lover and protector of my children, and I can promise you that I will do the same for the students in Salem C ity Schools because they deserve the best education. Second, I am an engineer. I worked for 20 years in the engineering and manufacturing industry, and understand what it takes to run a business. During my career, I managed multi-million dollar projects for large customers so I am familiar with making budget decisions and understand financial statements. As a career engineer, I am a problem-solver by nature. When I look at something, I don’t just see what is wrong. I start immediately thinking about how to fix it. A dd to this that I am a female in a male-dominated industry, and you have a recipe for a woman who is confident in tackling big issues regardless of the obstacles. Salem needs a problem-solver to help tackle issues our school system faces, and I am ready to take on that role. T hird, I am a professor. While my role is in higher education, I absolutely understand how to balance the needs of many students. I average over 400 students in my course. Due to my class size and the number of industry partners and other educators I work with, I am well-versed in understanding and pushing for positive morale amongst educators and stakeholders. I promise to keep all of the human dynamics in mind when making decisions for the school system because positive morale can go a long way in fostering a good school system. Finally, I'd like to add one more title to my resume: school board representative. My personal and professional experiences have prepared me for this role, and I would love to join a team of people to provide transparent, focused, and practical support to Salem C ity Schools’ teachers and students. As a Hokie graduate and employee, I live by Virginia Tech’s motto Ut Prosim, which means “that I may serve.” T hese words—and more importantly, their inspiration— have been instilled in me from age eighteen on. T hat I may serve T HIS school system would be a great honor. I thank you all for your time and attention, and I look forward to this opportunity! Teresa Sizemore-Hernandez, 309 Orchard Street, Salem appeared before Council and stated she would like to be considered for the School Board. Several years she spoke before C ouncil sharing her intent to serve on the board. Her intent has never changed; however, life events got in the way. She is back tonight to express her desire to serve the City on the board. She noted that Mr. Preston and the current School Board are doing a phenomenal job. Her intent is only to seek an appointment if C ouncil choses not to reappoint someone or if there is a vacancy in t he future. She further discussed her background, family, professional experience, and qualifications. She noted all of her children have attended or are attending Salem schools so she is familiar with the school system. She feels her wide range of knowledge will serve the C ity well, and she would like to use her skills to be able to give back to the schools. Sally Southard of 118 Par Drive, former Chairperson of the Salem School Board, appeared before the C ouncil. She noted that she is here in support of the reappointment of David Preston to the board. She noted that Mr. Preston was chosen by his fellow school board members to serve as chairman when she retired from the Board 6 1/2 years ago. Since then, he has successfully led the school division through some difficult economic times. She further discussed the reasons for reappointing D avid Preston to the Salem School Board and asked C ouncil to reappoint Mr. Preston. C indy Neathawk, 3074 Bentridge Lane, Salem, appeared before the C ouncil. She noted that she is here in support of the reappointment of D avid Preston. She served on the Salem School Board for 15 years and was fortunate to work with David for 4 1/2 years. She can speak from personal experience about his excellent qualifications and his effectiveness as a true servant leader who is always ready to listen to concerns and ideas. She further discussed the school board during his leadership and the reasons why C ouncil should reappoint Mr. Preston. Macel J anoschka, 200 Bentwood C ourt, Salem, appeared before the Council. She noted that she was here two years ago as President of the Salem C ouncil of PTAs to speak about the budget and the Salem Schools renovations. She is still the Council President, but she is here tonight as a parent. She is here in support of the reappointment of C hairman David Preston. She stated she does not know him personally, but she has seen him in action. She noted she had served as the parent rep on a committee that was considering cafeteria vendors several years ago and discussed Mr. Preston and his participation and leadership on this committee. She agrees that change can be positive, but change just for the sake of change is not going to be positive. She further discussed the reasons for reappointing David Preston to the Salem School Board. Andrea J ohnson, 2238 Maiden Lane SW, Roanoke, appeared before the Council. She noted she is the 2020 Virginia Teacher of the Year, and she is an English teacher and Department C hair at Salem High School. She stated that she has just recently passed the ambassadorship off to Anthony Swann. the 2021 Virginia Teacher of the Year, from Franklin C ounty Schools. She thanked Salem City Schools, Salem School Board, C hairman Preston, D r. Alan Seibert, Mr. Habeeb, and Salem C ity C ouncil for the unwavering support this past year as she served in this important leadership position in the State of Virginia. She further discussed her experience in representing the State and Salem in this role. She noted that as hard as this year has been any time teachers in Salem are faced ... Her motto as Teacher of the Year is "those who can, do, those who love, teach". Never has this been more true than this year. She looks forward to the ways that she can continue to support the School Board and Salem students as we learn new practices in our changing educational landscape. Nathan Overstreet, 815 Scott C ircle, and business owner at 2913 West Main Street, Salem, appeared before the C ouncil. He noted that he is present in support of J osh Kier for the open position on the School Board. He stated there a three things that really stand out about Mr. Kier. First is his passion for education, second is his desire to participate in public service, and third is his love for the City of Salem. All these things make him an excellent candidate for the open position. He further discussed Mr. Kier's qualifications and reasons why C ouncil should appoint him to the School Board. J im Soderberg, 57 Sawyer Drive, Salem, appeared before the C ouncil. He stated he is present in support of J osh Kier's nomination for the School Board position. He noted that many years ago he and his wife sold their home in Roanoke to move to Salem. T he reason for moving was the C ity of Salem Schools. He further discussed his three sons and their experiences in the Salem schools. He has a long history of interest in and following the Salem schools. Since 2008, he has been an instructor as Virginia Western C ommunity C ollege teaching courses in logic, philosophy and ethics. When he first started at Virginia Western, if he had a Salem High School graduate in one of his classes, he could count on that student being probably in the top 10% of his students. He is grateful for all that has been done for the students and some times hearing something we do not want to hear is important. In recent years he has had no Salem High School students in the top 10% of his classes. He further discussed Salem schools and noted that he believes we need to have a fresh prospective on the School Board as things have started to go off the rails. He does not know what it is but something has been happening that perhaps we are not aware of. He believes that Mr. Kier will bring that perspective with eyes that are much more open and respective to identify what is going on. Further, he read into the record a recent letter to the editor of the Wall Street J ournal from a retired college university professor. Mayor Turk asked if anyone else would like to speak on this matter. T here was no response, and the public hearing was closed. B.630 Union Street Authorize the C ity Manager to execute the agreement for the sale of a parcel known as 630 Union Street, Salem, Virginia, Tax Map #160-11-2, consisting of 1.4032 acres. (Public hearing was held on November 14, 2016.) Mr. Taliaferro noted the public hearing for the sale of this property occurred almost four years ago. He noted since that time there has been some interest in the property. Also, the company who was interested wanted to fill the property, and the fill would raise the property above the floodplain and make it much more useable. From the C ity's perspective, they were filling our property so they were making our property even better so we did not move or push the company on approving the contract. T he C ity Council at the time in 2016 agreed to the sale of the property for $100,000 with a few conditions. One was there is sewer line that crosses the property on the north side, and the purchasers have agreed to move this line at their own expense so there would be no fill on it. Additionally there are proffers on the potential uses for the property, which are mainly commercial type uses. T here is also a condition on the facade of the property, which has to be brick or stone, and a condition regarding a parapet wall facing the Union Street side of the property. William J ones motioned to approve the sale of the parcel known as 630 Union Street, Salem, Tax Map #160-11-2, consisting of 1.4032 acres. Randy Foley seconded the motion. Mayor Turk asked if there were any changes or discussion regarding the sale of this property. Vice Mayor Wallace noted he would like to offer an amendment to the motion. He noted he would like the time for the development of the property be changed to three (3) years instead of five (5) years so we can dispose of an empty lot sooner. Mr. J ones asked Mr. Taliaferro if this would be acceptable to the purchasers. Mr. Taliaferro noted that staff is waiting to hear back from the buyer regarding this. If C ouncil chooses to move forward with the three year condition, and this is not palatable to them, then staff can come back with an amendment. Mr. J ones noted that he would amend his motion with the proposed change by Vice Mayor Wallace. Mr. Foley seconded the amended motion. Vice Mayor Wallace noted for the public's information the C ity is selling this property at a significant discount because of the improvements that had to be made to this property before it could be developed which were completed at the purchaser's expense. William J ones motioned to authorize the C ity Manager to execute the agreement for the sale of a parcel known as 630 Union Street, Salem, Virginia, Tax Map #160-11- 2, consisting of 1.4032 acres with the condition the development of the property shall occur within three (3) years. Randy Foley seconded the motion. Ayes: Foley, J ones, Saunders, Turk, Wallace C .Appropriation of F unds Consider request to accept and appropriate State Homeland Security Program Grants. Audit - Finance Committee Vice Mayor Wallace noted the Audit Finance C ommittee met this morning to discuss this request. T he C ity has been awarded two State Homeland Security Grants totaling $121,850. T he SHSP Response Equipment grant funding of $45,850 will be used to purchase foam equipment at a cost of $17,910 and the remaining $27,940 will be used to provide foam training for Fire Department personnel. T he SHSP Special Ops Swift-Water/Flood Rescue Team grant funding of $76,000 will be used to purchase swift water rescue equipment. No local match is required for either grant. T he C ommittee reviewed the request and recommends accepting an appropriating the funding for the Homeland Security Program Grants. J ames Wallace motioned to accept and appropriate the State Homeland Security Program Grants funding for the Fire Department in the amount of $121,850. Randy Foley seconded the motion. Ayes: Foley, J ones, Saunders, Turk, Wallace D.Appropriation of F unds Consider request to accept and appropriate the C oronavirus Emergency Supplemental Funding Grant. Audit - Finance Committee Vice Mayor Wallace noted the Audit Finance C ommittee also discussed this request. T he City has been awarded $10,000 in federal C oronavirus Emergency Supplemental Funding Grant funds, which will be administered by the Virginia Department of C riminal J ustice Services. No local match is required. T he Police Department will use grant funds to purchase the One Solution Police 2 C itizen software program, which will allow citizens to submit non-emergency police reports. Having this program available will help the department better serve the community by allowing easier access for citizens to check the status of their reports, freeing up officers to respond to emergency calls for service and provide a safer, healthier way for officers to interact with victim and complainants while still providing investigative assistance. T his software will provide an alternative for routine customer service that reduces officers’ risk of exposure to coronavirus for non- emergency calls for service T he C ommittee reviewed the request and recommends accepting and appropriating the funding for the C oronavirus Emergency Supplemental Funding Grant. J ames Wallace motioned to approve accepting and appropriating the Coronavirus Emergency Supplemental Funding Grant in the amount of $10,000. Randy Foley seconded the motion. Ayes: Foley, J ones, Saunders, Turk, Wallace E.Approv al of B udget Transfer for C ARE S Act F unding Consider request to transfer budget for C A RES Act Funding. Audit - Finance Committee Vice Mayor Wallace noted this request was also discussed by the Audit Finance C ommittee. T he City received C A RES Act funding through the C oronavirus Relief Fund in the amount of $4,414,830. T he C A RES Act requires that these funds only be used to cover expenses that: are necessary expenditures incurred due to the public health emergency with respect to the C oronavirus Disease 2019 (C O VID- 19), were not accounted for in the budget most recently approved as of March 27, 2020 and were incurred during the period that begins on March 1, 2020 and ends on December 30, 2020. Any funds not spent by December 30, 2020 must be returned. T he School Division purchased additional C hromebooks at a cost of $360,000 to promote distance learning. T he committee reviewed the request and recommends allocating $360,000 of the City’s share of C A RES Act funding to help cover School Division purchases. Ayes: Foley, J ones, Saunders, Turk, Wallace F.Amendment to Administrativ e 2020 Calendar Consider request to amend the City of Salem 2020 Administrative Calendar. Mr. Taliaferro noted that last fall City C ouncil adopted the administrative calendar for the 2020 year. Staff noted the following regarding the request: the subject property consists of a single parcel of approximately 0.2 acres, located on the west side of Delaware Street, to the north of the intersection with 4th Street. It is occupied by a single family residence, with attached hair salon and parking area at the rear of the property. T he applicant states she would like to renovate and rent the former hair salon space behind the house as a separate residence. T his would require rezoning the property to allow for the issuance of a Special Exception Permit for a Two- Family Dwelling (Item 4B). Two-family dwellings are not allowed in C BD zoning. C hair Daulton opened the public hearing and asked if there was anyone to speak regarding the requests. Tammy Scaggs of 1797 Richland Hills Drive, Salem, representing her mother, Phyllis R. Booth McC raw, appeared before the C ommission explaining the rezoning and Special Exception Permit requests. She noted her mother used to operate a beauty salon in the space behind the house. T hey would like to convert this space to a one bedroom apartment. T he space is separate from the main dwelling and has a separate entrance. Mr. Garst asked if it this was attached to the main structure, and Ms. Scaggs noted that it was attached to the main structure. C hair Daulton asked if it there were separate meters for each, and Ms. Scaggs noted that there are separate meters for each space. Ms. Scaggs noted that there are duplexes on both sides of this property. Vice C hair King asked about the parking. Ms. Scaggs noted that there is some parking in the rear adjacent to the alley which could be used. Vice C hair King asked if there were any comments from the adjoining property owners, and staff noted that there were not. T he Executive Secretary reported that notice of said hearing had been published in the October 1 and 8, 2020, issues of the Salem Times-Register, and all property owners were notified by letter mailed September 28, 2020. Staff noted the following regarding the request: the subject property consists of a single parcel of approximately 0.321 acres. It is located at the northwest corner of Goodwin Avenue and Richards Lane. T he property is occupied by a two-family dwelling. T he applicant states that they have been unsuccessful at renting the property for residential uses due to the surrounding commercial activities and would like to change its use to a commercial one. T hey also own the two parcels to the south (1121 and 1111-1107 West Main Street) and would like to create a parking area at 16 Goodwin that will allow additional parking for those properties to make them more attractive for redevelopment. T he Executive Secretary noted that Items 4C and 4D are related to the same property so if the Commission would like it can be handled as one public hearing. C hair Daulton opened the public hearing and asked if there was anyone to speak regarding the requests. Ben C rew with Balzer and Associates, representing the contract purchaser, appeared before the C ommission explaining the rezoning and Special Exception Permit requests. He noted that the contract purchaser is also with him this evening. He stated that this request has been months and years in the making based on careful consideration by the contract purchaser. T he property has been for sale for some time and and has had limited success over the years as a residential structure. T he property is unique due to its location directly across the street from what he contends is one of the busiest drive thru restaurants on West Main Street. T his makes it a challenging site for residential use. T he contract purchaser also owns the properties located across Richards Lane which are 1107-1111 and 1121 West Main Street. He further noted this project provides an excellent opportunity to the City of Salem to gain additional commercial property in a suitable location, while supporting existing businesses and helping to promote future re-development along West Main Street. Payal Shah of J SS Holdings, LLC , 5855 Winbrook Drive, Roanoke, appeared before the C ommission. Ms. Shah noted her company wants to make Salem a beautiful and vibrant place. She further discussed the project and noted that her company is trying to bring new national tenants to Salem. She noted that they currently own the properties located at 1107-1111, 1121 and 903 West Main Street. C hair Daulton asked if they planned to tear down the existing building on the property in order to provide the additional parking shown on the concept plan submitted. Ms. Shah noted that they will keep the building because there is enough room on the back of the property for the parking. Vice C hair King asked how many parking spaces are they proposing to add. Ms. Shah noted that they would be gaining 16 parking spaces. T here are already two spaces in the front. Mr. C onner asked what would be the uses for the building. Would it be offices or retail? Ms. Shah stated at this point they do not know the uses, but it might be used for offices or a spa or something like that. Mr. C rew stated that this is a small structure so there are very limited uses for the building. T hey would anticipate some sort of small user due to the constraints of the existing structure. Vice C hair King noted the information submitted talked about buffering. She asked if they would be buffering the northern and eastern lines. Mr. Crew noted that this was correct. T here was further discussion regarding the additional parking on the rear of the property. Mr. C onner asked staff if this was the least intensive zoning that will allow them to do what they are trying to do. Would RB Residential Business zoning support the parking and maybe an insurance agent or something like that? Ms. Wines noted that it is not the least intensive that it could contain an office or medical office right now; but looking at the future, the proposed zoning would encompass what the contract purchaser would potentially want to do with this corner. It could be zoned a lighter commercial use which would cover what they would like to do currently, but they might have to come back in the future to ask for it to be rezoned again, if they further develop this corner. C hair Daulton asked staff if the 16 parking spaces is an issue. Ms. Wines noted that this is not a problem as this would have to go through site plan review so staff will make sure that it meets all the regulations. Further, she does not think the parking will be a problem. T here was further discussion regarding the parking and site plan review requirements. Mr. Beamer asked staff if they were okay with the request. Do they see any hiccups, etc.? Mr. Tripp noted he believes this is a question of does the C ommission see this request as appropriate. If they see it as appropriate to change the use/zoning as the applicants are requesting, then they should recommend it be rezoned. Staff will make sure that the project meets all the C ity regulations with regards to site plan approval. Mr. Taliaferro noted to expand on the question regarding the parking. It makes it a lot cleaner to have the off-site parking property the same zoning as the principle use because we would not want a commercial property to use a residential-zoned property for off-site parking. T here was additional discussion regarding the proposed zoning classification for the property. Mr. G arst asked if there are any limitations on lighting since this will be bordering two residential properties. Mr. C rew noted they will have to meet the same lighting standards whether it is next to a commercial site or next to a residential site. He noted the foot candle requirements at the property line which will be more effective in this situation because of the evergreen buffering on the residential sides. He believes the intent is to have enough light for the parking to make it safe, but it will not be a bright lit up parking lot next to residential uses. Mr. Beamer asked about the buffering for the northern and eastern property lines. He further asked if there would be a fence, also. Mr. C rew noted a Type B buffer will be required. T he Type B buffer consists of an eight-foot buffer yard, one row of small evergreen trees, one row of evergreen shrubs. T hey are not proposing a fence at this time. Lorrie C oe-Meade of 825 N. Twelfth Street, Wytheville, and 19 N . Bruffey Street, Salem appeared before the C ommission in opposition to the request. She noted her husband is also in the audience. Billy Meade of 825 N. Twelfth Street, Wytheville, and 19 N. Bruffey Street, Salem appeared before the C ommission in opposition to the request. He noted the owners of the property have stated they have been unable to rent the property because of the appearance of the outside and because the McD onalds. If the property owners had maintained the property, then they might have been able to rent it. He noted that the property looks like a junk yard. He would not want to rent it if he was looking for rental property. He further discussed the other neighbors in this area, and he objects very strongly to this property being rezoned. Mrs. C oe-Meade noted that they are very concerned about the disruption and also the depreciation of their property. T heir intent is to retire at this location. If the lot is rezoned, it does not matter what they intend to do with it now. With the proposed zoning, they can do what they want with the property in the future. Further, they are concerned about the lighting of the proposed lot and how it will influence their back yard as well as their bedrooms that are on the back of the house. T hey are also concerned about the increase in traffic on Richards Lane and the potential to further compromise safety in this area. In addition, they are concerned about trash on Richards Lane as there is already a problem with trash on the street, and they are constantly having to clean it up. Finally, they are not opposed to progress in Salem, but they are opposed when it infringes on their home, property and the value of their home and property. Mr. C onner asked staff about the science regarding light pollution, placement of light poles, etc. in the site plan review process. Mr. VanAllman noted that there is quite a lot of information about this, and it is a lot better than it was 20 years ago. He noted that there is no spillage of light, and it is usually very accurate. He further discussed site plan review as it relates to lighting. Vice Mayor King asked about the buffer yard shown on the concept plan. How big will the shrubs get? Will they completely block the site from view of the adjacent properties.? Ms. Wines noted the buffer yard is actually a mix of evergreen trees and shrubs that will be required. T he evergreen trees will grow tall enough to make a good screening between properties. C hair Daulton asked if the requirement is for 8' tall evergreen trees, and Ms. Wines noted she believed that the requirement is 6' tall at planting and spaced 25' apart so that they will grow into a large evergreen wall. C hair Daulton noted she believed that at this point the applicant does not own the property. She asked if this was correct. Mr. C rew noted that this was correct. He noted the existing maintenance or the lack thereof is on the current property owner. T here is certainly an opportunity to clean up and improve this property which his clients intend to do. Mr. Garst noted he thought one of the reasons why the structure has been difficult to rent for residential is due to the way it has been chopped up internally for multiple tenants. Is this correct? Mr. Crew noted that this was correct. C urrently it is approved as a two-family dwelling, but it has been chopped up for multiple residences. C hair Daulton asked if Richards Lane is city owned, and it was noted that it is a public right of way. T here was further discussion regarding the lack of rental of the existing structure. C hair Daulton noted if the applicant is not the owner, how do they know the property is unrentable. Mr. C rew noted that they did not state the property was unrentable. T his was an assumption as far as he knows. He further discussed the property and noted that is has been vacant for some time and further, has been for sale for an extended period of time. T here was additional discussion regarding the existing structure and the use of the property in the past. Mr. C onner asked if the contract purchaser has prospects who are interested in renting the property subject to getting the rezoning. Or are they just trying to buy the property in the manner that prepares it best for marketing or has this idea been pitched and has happened very rapidly. Ms. Shah further discussed the proposed use of the property and noted that their intent is to bring a national tenant to this corner. (T here was difficultly understanding Ms. Shah's answer due to the quality of the audio.) C hair Daulton noted with this being a commercial piece of property, would the parking lot lights have to stay on all night? Would there be a way that they could be turned off say at 9:30 or 10 pm? Mr. VanAllman noted he did not think they would have to stay on all night. He would have to look into what would be required with regards to security after the business is closed. T here was further discussion regarding the lighting for the proposed parking lot. T here was further discussion regarding the proposed use of this property as well as the two structures fronting on Main Street owned by the contract purchaser. One additional speaker could not be identified or understood due to the quality of the audio. C hair Daulton asked if there was anyone else to speak. C hair Daulton opened the public hearing and asked if there was anyone to speak regarding the requests. Mark Patterson, 5034 Falcon Ridge Road, Roanoke, and Daniel Austin, 1238 Red Lane, Salem, with Dominion Service and Parts, LLC, appeared before the C ommission. He noted that they have been in business together for almost 10 years. Daniel operates the service side of the business, and he operates the sales side of the business. Currently they are operating the sales side of the business at 1206 West Main Street. T hey would like to consolidate and move the sales side in with the service side at the property on West Fourth Street. T his is the reason for the request. At the present time the west end of the property is being used for storage. T hey are planning to clean this up, and this will be where the used vehicles will be displayed for sale. Further, they will only have about 10 or 12 cars at a time. He noted there a times when people are not able to repair their vehicles, and they will buy the vehicle, repair it and resell it. T hey have to have a dealers license in order to do this. Mr. Garst asked if this is their typical model. So they do not go out and buy multiple vehicles and bring them back and sell them, is that right? Mr. Patterson noted that he does some times buy multiple vehicles, but that is primarily a wholesale function of the business and they mostly deal in retail. Vice Mayor King asked if they were aware of the requirements of this particular zoning with regards to perimeter landscaping and also storage of vehicles. Mrs. King read the sections of the code related to these items. T here was further discussion regarding the storage of vehicles. Mrs. King asked staff if the difference is because of the zoning that they will need for this use. Ms. Wines noted that any automobile repair, major business is required to have any vehicles that are stored on site longer than 72 hours be in a screened area. She noted that when Mr. Austin moved to this location, this was discussed with him. T here was additional discussion regarding storage of vehicles, etc., but due to poor quality of the audio, it was difficult to hear the discussion. Mr. Beamer asked if Mr. Austin is this is the business that is right behind the transmission shop. Mr. Austin noted that he currently rents the property out that is behind the transmission shop. Mr. C onner asked staff if the screening requirement that has been noted, is that even required in the Heavy Manufacturing zoning. Ms. Wines noted for the proposed use, automobile repair service, major, yes, it is a requirement. T here was further discussion regarding the screening requirement, and Ms. Wines noted that any vehicle that is stored on the lot more than 72 hours has to be stored in a screened in area. She noted that are variables in the screening area, and she further discussed those options. Mr. Patterson noted that what will be displayed on the lot will be retail, clean, and ready to sell vehicles which have been serviced by Dominion Service. T he intent of the business is not to be a wholesale business. Mr. Beamer asked what was the footage of the property on the west side of the building. Mr. Austin noted that it is approximately 100', but there is an easement across this property to access the parking lot next door. Mr. Beamer noted that on the right side there are a lot of vehicles. Are those vehicles to be worked on or what is going on with those vehicles? T his is where the proposed car lot will be, is that correct? Mr. Austin noted that some of those vehicles belong to employees and yes, this is where the proposed car lot will be located. Due to poor quality of the audio, it was difficult to hear the entire discussion. Mr. Beamer noted that they are currently leasing the property and that it is owned by Tony Rippee. Is that correct? Jordan, Director of Finance SUMMARY OF INFORMATION: The School Capital Projects Fund budget was amended for fiscal year 2020-2021 by the School Board at their meeting on October 13, 2020. The Board amended the Capital Projects Fund to appropriate $1,905,293 from the unallocated capital reserve funds, appropriate $529,805 from the unallocated meals tax and appropriate $81,000 from unallocated cafeteria reserves funding for a variety of projects. The attached memo covers the various appropriation changes. Also included to this memo is the CIP document for the six-year period of fiscal years 2022 – 2027. FISCAL IMPACT: Appropriation changes totaling $2,519,298 to be made to the School Capital Projects Fund. STAFF RECOMMENDATION: Staff recommends that Council approve the School Board’s appropriation change of $2,516,298 to the Capital Projects Fund per the attached reports. Staff also recommends approval by City Council of the six-year CIP document submitted by the School Board. Item # 4I Date: October 26, 2020 Salem City Schools Capital Improvement Plan (CIP) for 2022-2027 and Projects for FY 2021 October 13, 2020 Summary of Issue: This report is to request the Board to: 1. Approve the proposed projects for FY 2021 from the 6/30/2020 year-end balance and the funding of these projects (Capital Reserve) (Attachment A with Appendix 1 for CTE Improvements & Appendix 2 for Finishes/Flooring lists) 2. Approve the proposed projects for FY 2021 from the 6/30/2020 year-end balance and the funding of these projects (Meals Tax) (Attachment B) 3. Approve the proposed projects for FY 2021 from the 6/30/2020 year-end balance of the Cafeteria fund and the funding of these projects (Attachment C) 4. Approve the proposed 2022-2027 Six Year CIP (Attachment D) Background: Salem’s school buildings require on-going major maintenance projects on a regular basis due to age. In recent years this has included such things as roofing replacement, heating and air conditioning work, building renovations, door and window updates, classroom upgrades and similar. In addition, the division has used capital reserve funds traditionally to replace buses, supplement its technology budget, and replace major cafeteria equipment on a planned regular basis to even out future necessary outlays. With the balance available from this past fiscal year, the projects in attachment A are the requests from the Division on how to use these funds. There are 4 categories of how a fund balance is to be reported in the Capital Projects Fund for financial reporting purposes within the statement: 1. Restricted Fund Balance - restricted by external creditors (debt covenants) grantors, contributors 2. Committed Fund Balance - amounts that can only be used pursuant to constraints imposed by legislation, resolution, or ordinance and the constraints can only be removed by the same method 3. Assigned Fund Balance - amounts that are constrained by the government’s intent to be used for specific purposes, but neither restricted or committed 4. Unassigned Fund Balance - any residual fund balance not in the first 3 categories. On November 28, 2011, City Council approved a 2% tax rate increase on the Meals Tax for the City, and dedicated the proceeds to go to School Capital Projects. The tax became effective February 1, 2012. With the balance available from the past fiscal year, the projects in attachment B are the requests from the Division on how to use these funds. Over the past several years, the division has been growing the reserves in the cafeteria fund from positive year-end balances. The State recommends we keep a minimum three (3) months expenditures in reserves at all times, and we have in excess of that with the balance at the end of FY 2020. We recommend funding the cafeteria capital needs from the reserve balances in the Cafeteria fund as listed in attachment C. Policy Reference: FB, Facilities Planning Fiscal Impact: At this time, $1,905,293 of the unallocated capital reserve funding will be categorized in Assigned Fund Balance with the remaining being categorized as Unassigned Fund Balance. SUBMITTED BY: Rosemarie B. Jordan, Director of Finance SUMMARY OF INFORMATION: When the fiscal year 2021 budget for the Salem Civic Center was adopted, staff was hoping to schedule a shorter version of the Fair in the fall and budgeted revenue and expenses based on this plan. However, the event could not be held. The operating budget needs to be adjusted for this cancellation. In addition, additional funding of $41,000 is needed for the Civic Center boiler replacement project. Funding has been transferred from the General Fund to cover the additional cost. FISCAL IMPACT: The Civic Center operating budget needs to be adjusted for the cancellation of the Fair and for the additional transfer from the General Fund. STAFF RECOMMENDATION: City staff requests Council to make the attached adjustments to Fair revenue and expenses since the shorter version of the event did not happen. In addition, staff recommends increasing the Transfer from General Fund revenue account, 53-053-0040- 44716 by $41,000 and the Building Improvements expense account, 53-053-0041-58009 by $41,000.
