1.Call to Order
A regular meeting of the Council of the City of Salem, Virginia, was called to order
at 6:30 p.m., there being present all the members to wit: Renee F. Turk, Mayor,
James W. Wallace, III, Vice-Mayor, Council members: Byron Randolph Foley,
William D. Jones, and John E. Saunders; with Renee F. Turk, Mayor, presiding;
together with James E. Taliaferro, II, City Manager; Rosemarie B. Jordan, Director
of Finance; Charles E. VanAllman, Jr., Community Development Director; Mike
Stevens, Communications Director; Larado Robinson, Director of Water and Sewer
Department; Judy L. Hough, Deputy City Clerk; and Stephen M. Yost, City
Attorney.

A.Citizens' Comments
Comments from the public, limited to five minutes, on matters not on the regular
meeting agenda. (Name, address, and topic are required.)
John Breen, 142 Bogey Lane, appeared before the Council. He noted the topic of
his comments is New Beginnings. He stated the Simms' rezoning created a group
and legal review of Salem's operations, Charter and Codes. It revealed a "we've
always done it that way." More extensive research was undertaken and is ongoing. It
includes and included phone calls, FOIA's or correspondence to Salem, VDOT,
DEQ, Attorney General's office, Secretary of State, and various attorneys. An
essential conclusion was that Salem would benefit from various new beginnings that
build on the good, discard the outdated or ineffective and embrace positive change.
A series of suggested new beginnings will be provided to Council. Basic common
place Codes and accountability measures, which exist throughout Virginia, but not in
Salem, will be suggested. This and all future communications are not intended or
should they be construed as a personal attack. He further discussed some initial
observations and suggestions for improvement. He stated that Salem citizens need
answers to basic fundamental questions. He thanked Council for the opportunity to
discuss issues and suggestions for new beginnings.

Ginny Coleman, 1500 Longview Avenue, appeared before the C ouncil. She noted
that she and her husband, Wilton, purchased their home 15 years ago in Middleton
Gardens. T hey are very concerned about the neighborhood. Due to health
conditions, they are having to move to a retirement community. T hey put their house
on the market and before it had been on the market for five hours, they had a
contract. Before the contract could be signed, the C ity had all the rain a few weeks
ago, and they got six inches of water and sewer backup in their basement. T hey had
to have a cleaning company come in and clean it and strip the basement, etc. It
knocked their sale of the property. T heir neighbors on the street also got water in
their basement at the same time. She noted she had a petition with 15 of the
neighbors' signatures who are very upset. T his has been going for 15 years, and the
C ity has known about this problem, but they have pushed it under the rug. It is time
to bring it out, and it is now time for the C ity to address it. She noted that the C ity
has continued to add houses and businesses to this line, and it is overloaded. She
noted the storm drain in front of her house needs to be replaced because it is not big
enough to accommodate the houses that were built up on the hill behind them. She
further noted the C ity took the easy way out and put these stop gap things in their
yards forcing each resident to buy one and put them in their yard. T he C ity paid
$1,000 and the residents had to pay the difference. She stated it is past time for
Salem to do something about this. She is asking the C ity to reimburse she and her
husband for the expenses they had to put out to fix the City's problem.
Sarah C ox of 1430 Longview Avenue appeared before the C ouncil. She read the
following petition for the record: "we, the undersigned tax-paying citizens, who
reside in Middleton Gardens, within the C ity of Salem, bring this petition before the
Salem C ity Council on August 10, 2020. T here are 36 homes on Longview Avenue.
T he sewer drain line in our neighborhood is only 15 inches wide and ends at our
dead-end street. During heavy rainstorms, the City's storm water drain lines spill
over into the sewer drain lines. Once the sewer line fills up at the far end of
Longview Avenue, at the dead-end, it starts to back up in the basements of every
home on the street that has a basement, through floor and shower drains and toilets,
all the way to Poplar Avenue. T hese sewer backups have caused major damages, on
multiple occasions, to our properties that we have had to clean up on our own
without any help from the C ity of Salem and on some occasions, our health, and
well-being was compromised during these occurrences. We have brought our
concerns about the failed sewer line to the Water and Sewer Departments, the C ity
Manager, and the Risk Manager without any resolution to the sewer line issues. T he
C ity did send a letter stating they would pay $1,000 toward a backflow preventer,
which is now code for new homes. Unfortunately, this backflow preventer costs
more than what the C ity is willing to reimburse, making it a financial burden on the
residents. We are asking and expecting the City of Salem to fully install or
reimburse the full cost of the recommended backflow preventer at each property on
Longview Avenue, as well as, swiftly upgrade the sewer and storm water drain lines
in Middleton Gardens to adequately handle the flow of water and sewer and finally,
to reimburse homewoners for damage caused by the failed sewer sewer system.
Please Salem City C ouncil, do not let this fall on deaf ears."
Mayor Turk asked for a show of hands of those in the audience who also have had
the same issue. T here were several in attendance who raised their hands.
Mr. J ones noted he has asked the City Manager if he could look into whether the
C A RES Act funding could be used to correct this problem in the C ity. He further
noted that he met with Mrs. C oleman and Mr. Hudson after this happened. Further,
this problem is not going to be resolved overnight.
Mayor Turk asked the Director of Water and Sewer, Larado Robinson, if he could
explain what it might take to resolve this issue and what kind of priority this might
have. Mr. Robinson clarified what Mrs. C oleman was talking about regarding the
back water valve. He noted that they have a plan in place where they offer up to
$1,000 to residents who sign up to install one of the valve if they are at risk for a
backup. Obviously, we have recently had some unprecedented rainfalls, and
unfortunately, our sewer system is not designed to be water tight. He further
discussed the problems with the City's sewer lines. A lot of those lines have not
been updated in years, but we are under a consent order by the D EQ to upgrade
those lines. We have been working to upgrade the lines in the C ity, and this area of
the C ity will be upgraded during the next phase which is three to five years away.
He discussed other efforts the department has been undertaking with regards to
checking out lines downstream, etc. T his area of the C ity is not the only one with
issues. He further discussed the sewer line issues and possible solutions to the
problems.
T here was additional discussion about the sewer line issues in the C ity and possible
solutions to the problems.

A.Conv eyance of P roperty
Hold a public hearing to consider the sale of the property located at 2102 West
Main Street, Tax Map # 137-2-1, consisting of 2.68 acres. (As advertised in the
J uly 30, 2020, issue of the Salem Times Register.)
Mayor Turk opened the public hearing and asked if there was anyone to speak on
this matter. T here was no response, and the public hearing was closed.
Mr. Yost noted that any proposal(s) for the purchase of the property would need to
come back to C ouncil at another meeting for their consideration. Mayor Turk
thanked Mr. Yost.
Mr. Taliaferro noted this is the C arilion building on West Main Street. T he C ity
purchased this property a year and a half or two years ago. T his property sits to the
west of the Hardees on West Main Street. For years we have had difficulty getting
developers to develop the western part of West Main Street from Wildwood Road
to the west city limits. T he C ity saw the purchase of this building as an opportunity
to take control of the entrance to that corridor. We did not purchase it with the
intention of keeping it forever. T his is the first step in the process of selling the
property.
No action was taken on this item.
B.Appropriation of F unds
Consider request to accept and appropriate the Rescue Squad Assistance Fund
grant. Audit - Finance
Vice Mayor Wallace noted the Audit Finance C ommittee met this morning to
discuss this request. He noted that this request pertains to the Salem Fire and EMS
and not the volunteer Rescue Squad. T he C ity has been awarded $68,917.52 in
Rescue Squad Assistance Fund grant funding from the Office of Emergency
Medical Services. Funds will be used to pay for half the cost of four cardiac
monitors. A 50% local match is required, which is available in the Reserve for
C apital account. T he C ommittee reviewed the request and recommends accepting
the Rescue Squad Assistance Fund grant and appropriating $68,918 in state grant
revenue for the purpose stated above.
J ames Wallace motioned to appropriate a $68,918 state grant for the purchase of
cardiac monitors for the Fire and EMS Department and a $68,918 match from
capital reserves. J ohn Saunders seconded the motion.

C .Appropriation of F unds
Consider request to appropriate WanderLove grant funds from Virginia Tourism
Corporation. Audit - Finance C ommittee
Vice Mayor Wallace noted the Audit Finance C ommittee also discussed this
request. T he C ity of Salem has been awarded $10,000 from the Virginia Tourism
C orporation’s (VT C ) D MO Recovery Grant program. T he grants are designed to
provide immediate recovery marketing funds to destination marketing organizations
(D MOs) across the state that have been heavily impacted by the novel coronavirus
pandemic. While the grant does not require a cash match, destinations have pledged
a collective in-kind match. Salem’s in-kind match will be covered through
marketing plans already in place. Proceeds from the grant will be used for
marketing, which was not included in the budget. T he Committee reviewed the
request and recommends appropriating the $10,000 in grant funds for the purpose
stated above.
J ames Wallace motioned to approve appropriating a $10,000 Virginia Tourism
C orpration's grant to promote tourism during the pandemic. Randy Foley seconded
the motion.

D.P atel Residence E SC P lan
Consider setting bond for erosion and sediment control for the Patel Residence ESC
Plan located in the 700 block of High Street. Audit - Finance Committee
Vice Mayor Wallace noted the Audit Finance Committee also discussed this
request. T he Committee reviewed the estimate for erosion and sediment control for
the Patel Residence ESC Plan to be located in the 700 block of High Street. T he
C ommittee concurs with the C ity Engineer’s office recommendation that bond be set
in the amount of $10,098 and a time frame for completion set at twelve (12) months.

E.Carryov er of Stormwater Management F unds
Consider request to reappropriate unspent stormwater management program funds.
Audit - Finance C ommittee
Vice Mayor noted this request was also discussed by the Audit Finance C ommittee.
Stormwater management programs were implemented by local governments
effective J uly 1, 2014 as required by the State to comply with the Clean Water Act
of 1972. On September 12, 2016, City C ouncil adopted a policy to allow staff to
administratively appropriate stormwater management funding not expended at the
end of each fiscal year, if the carryover amount was less than $25,000. As of J une
30, 2020, funding of $43,209 was unspent and needs to be reappropriated in fiscal
year 2021. Since the carryover amount is more than $25,000, C ouncil action is
required. T he C ommittee reviewed the request and recommends appropriating the
funds to fiscal year 2021 budget.
J ames Wallace motioned to approve appropriating $43,209 from the prior year
Storm Water account to the current year. J ohn Saunders seconded the motion.

F.Boards and Commissions
Consider appointments to various boards and commissions.
Vice Mayor Wallace motioned to appoint Chelsea Dyer to the Board of Appeals
(USBC Building C ode) as an alternate member for a five-year term ending August
9, 2025. Randy Foley seconded the motion.

Randy Foley motioned to reappoint Skip Lautenschlager to the Roanoke Valley
Greenway C ommission for a three-year term ending September 26, 2023. Bill J ones
seconded the motion.

William J ones motioned to appoint J ohn Saunders to the Roanoke Valley
Transportation Planning Organization (T PO) Policy Board as an alternate member

RE: Hold public hearing to consider the request of Riverland Oaks, LLC,
contract purchaser, and Higgs Family Trust, property owner, for the
issuance of a Special Exception Permit to allow a two-family dwelling on
the property located at 422 South Broad Street (Tax Map # 145-12-7).
SITE CHARACTERISTICS:
Zoning: RSF Residential Single-Family District
Future Land Use Plan Designation: Residential
Existing Use: Vacant
Proposed Use: Two-Family Dwelling
BACKGROUND INFORMATION:
The subject property consists of a single parcel of 0.277 acres, with a
lot width of forty-six (46) feet and a depth of two hundred sixty two
(262) feet. It is located on the east side of South Broad Street, to
the north of the intersection with Gray Alley. The property fronts both
on South Broad Street and White Oak Street.
The property is currently vacant as the existing home was demolished in
January 2005. In March of that same year the Board of Zoning Appeals
denied a variance request that would have allowed a reduction in lot
width and area so the lot could be subdivided, and two single-family
dwellings built.
The petitioner is requesting a permit to allow a front to back two-
family dwelling.
ISSUES:
The portion of the lot furthest east lies within the 100-year floodplain.

A regular meeting of the Planning C ommission of the C ity of Salem, Virginia, was
called to order at 7:00 p.m., there being present the following members to wit: Vicki
G. Daulton, Chair (absent); Denise P. King, Vice C hair; Reid A. Garst II, N.
J ackson Beamer, and Neil L. C onner (absent); with Denise P. King, Vice Chair,
presiding; together with C harles E. VanAllman, J r., C ommunity Development

A.Special Exception P ermit
Hold public hearing to consider the request of Riverland Oaks, LLC , contract
purchaser, and Higgs Family Trust, property owner, for the issuance of a Special
Exception Permit to allow a two-family dwelling on the property located at 422
South Broad Street (Tax Map # 145-12-7).
T he Executive Secretary Pro Tem reported that notice of said hearing had been
published in the J uly 30, and August 6, 2020, issues of the Salem Times Register,
and all property owners were notified by letter mailed J uly 27, 2020.
Staff noted the following regarding the request: the subject property consists of a
single parcel of 0.277 acres, with a lot width of forty-six (46) feet and a depth of
two hundred sixty two (262) feet. It is located on the east side of South Broad
Street, to the north of the intersection with Gray Alley. T he property fronts both on
South Broad Street and White Oak Street. T he property is currently vacant as the
existing home was demolished in J anuary 2005. In March of that same year the
Board of Zoning Appeals denied a variance request that would have allowed a
reduction in lot width and area so the lot could be subdivided, and two single-family
dwellings built. T he petitioner is requesting a permit to allow a front to back two-
family dwelling. T he portion of the lot furthest east lies within the 100-year
floodplain.
Vice Chair King opened the public hearing and asked if there was anyone to speak
regarding this request.
Patrick Snead, Manager Member of Riverland Oaks, LLC , appeared before the
C ommission explaining the Special Exception Permit request. He noted the
members of the company are lifelong residents of the community and focus on
giving back to the community. T hey are proposing to build a back to back two-story
duplex with one home facing South Broad Street and the other home facing White
Oak Street. T here will be ample off street parking provided for each home. He
further discussed the proposed project and noted that updated handouts had been
provided to the Community Development office.
Mr. Garst asked if the units would be rental, and Mr. Snead noted that they would
be rental units. Mr. Garst asked what would be the price range, and Mr. Snead noted
that the rental rate would be approximately $1,400 plus pets.
Mr. Garst asked if this would be marketed for college students, and Mr. Snead
noted that college students are not their target market.
Vice C hair King asked if there was anyone else to speak on this matter. T here was
no response, and the public hearing was closed.
Reid Garst motioned to recommend to the Council of the City of Salem that the
request of Riverland Oaks, LLC , contract purchaser, and Higgs Family Trust,
property owner, for the issuance of a Special Exception Permit to allow a two-

B.Amendment to the Zoning Ordinance

Edward Andrew Riner Revocable Declaration of Trust, Edward Andrew Riner -
Trustee, property owner, for rezoning the property located at 201 Northern Trail
(Tax Map # 10-1-1.1) from RSF Residential Single Family District w/conditions to
RSF Residential Single Family District w/ amended conditions.
T he Executive Secretary Pro Tem reported that notice of said hearing had been

on the north side of of Northern Trail, to the east of the intersection with Polar
Lane. T he petitioners wish to have a driveway access from Polar Lane leading to an
attached garage. In 2007 the rezoning of the parent parcel was granted with proffered
conditions. During the meeting the applicant voluntarily proffered that here would
be no access to Polar Lane from several of the lots, including this one.
Unfortunately, this condition was erroneously left out of the final ordinance,
however, in recognition of the proffer, it was added to the subdivision plat approved
by Planning C ommission later that year. T he request relates only to the condition
prohibiting access from Polar Lane to lot 1.
Vice Chair King opened the public hearing and asked if there was anyone to speak
regarding this request.
Steve Poff with Boone T homas Homes, applicant, representing the property owner,
appeared before the C ommission explaining the rezoning request. He noted that the
original rezoning in 2007 placed several conditions on this subdivision. T hey are
requesting to amend one of those conditions which prohibits access from Polar
Lane. T he property owners would like to build a home with a side entry garage as
this is the best way to access the proposed construction due to the topography. If
they were to build the proposed house with the entrance from Northern Trail, it
might require a retaining wall. Further, he feels the houses with the side entry
garage look asthetically better for a corner lot. T here are no sight distance issues
related to the request. In addition, no other lot in the subdivision would benefit from
amending this condition.
Vice Chair King noted she had been by the property. T here is currently a gate on
the side of the property on Polar Lane. She asked if this would be where the
driveway would go, and Mr. Poff noted that yes that is his target for the driveway.
T here was further discussion regarding the elevations for the subdivision.
Vice C hair King noted that the proposed driveway will more than likely line up with
the driveway on the other side of Polar Lane.
Vice Chair King asked Mr. VanAllman if he knew the reason why the condition was
placed on the subdivision prohibiting access to Polar Lane from the subdivision lots.
Mr. VanA llman noted he thought there was some concern about the width of Polar
Lane and that the neighbors were concerned with sight distance with driveways being
put in on the street. So the developers decided to proffer that they would not have
any driveways on Polar Lane. He does not remember it being a big issue. Further,
he did drive up to the subdivision to verify the safety, and he does not see a problem
with putting the driveway for this lot on Polar.
Vice C hair King asked about the sight line distance. She noted that she drove down
Northern Trail and came back to Polar Lane, and she did not have an issue with
sight line. Mr. VanAllman noted that the plat provided with the request does have
the sight distances noted, and the plat was prepared by a licensed surveyor and a
professional engineer has to certify the plat is correct.
Mr. Garst asked if the driveway would be wide enough for the owners to back out
of the garage and turnaround and pull out onto Polar. Mr. Poff noted that there
should be enough room to put a turnaround.
Vice C hair King asked if there was anyone else to speak on this matter. T here was
no response, and the public hearing was closed.
J ackson Beamer motioned to recommend to the Council of the City of Salem that
the request of Boone T homas, applicant, and Edward Andrew Riner Revocable
Declaration of Trust, Edward Andrew Riner - Trustee, property owner, for rezoning
the property located at 201 Northern Trail (Tax Map # 10-1-1.1) from RSF
Residential Single Family District w/conditions to RSF Residential Single Family
District with amended conditions be approved as presented for Lot 1, 201 Northern

AN ORDINANCE TO AMEND SECTION 106-110, ARTICLE I, CHAPTER 106, OF THE
CODE OF THE CITY OF SALEM, VIRGINIA, RELATING TO ZONING AND DIVIDING
THE CITY INTO BUILDING DISTRICTS AND ESTABLISHING DISTRICT BOUNDARY
LINES ON THE ZONING MAP OF THE CITY OF SALEM, VIRGINIA.
WHEREAS, Edward Andrew Riner Revocable Declaration of Trust, Edward Andrew
Riner - Trustee, property owner, and Boone Thomas, applicant, have heretofore petitioned to
have the property located at 201 Northern Trail (Tax Map # 10-1-1.1) being Lot 1, Rivendell as
shown on that certain Subdivision Plat recorded in Plat Book 12, pages 31-32, in the Clerk’s
Office of the Circuit Court of the City of Salem, Virginia (herein “Property”) rezoned from RSF
Residential Single Family District with conditions to RSF Residential Single Family District
with amended conditions; and
WHEREAS, in said petition, Edward Andrew Riner Revocable Declaration of Trust,
Edward Andrew Riner - Trustee, property owner, and Boone Thomas, applicant, did voluntarily
proffer amended zoning conditions from the July 9, 2007, conditional rezoning of an
approximate 9.28-acre parcel of which the Property is a part located on Polar Lane to the
regulations provided for in RSF Residential Single Family District; and
WHEREAS, Council has reviewed the proposed amended conditions and is of the
opinion that the requested rezoning without the proposed amended conditions would not be in
the best interests of the City and that the amended conditions will more closely comply with the
intent of the Land Use Plan heretofore adopted; and
WHEREAS, Council has adopted the provisions of Chapter 320 of the 1978 Acts of the
General Assembly of Virginia, Sections 15.2-2296 through 15.2-2302, relating to conditional
zoning as set forth in Sections 106-522 et seq. of the Code of the City of Salem, Virginia; and
WHEREAS, the Planning Commission at its regular meeting held on August 12, 2020,
did recommend to Council after holding a public hearing that such conditional rezoning be
approved with the amended voluntarily proffered conditions; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, VIRGINIA, that
Section 106-110, Article I, Chapter 106, of The Code of the City of Salem, be amended, revised,
and reordained to read as follows and the map referred to shall be changed in this respect and no
other:
Section 1. That the Property, as described herein, of Edward Andrew Riner
Revocable Declaration of Trust, Edward Andrew Riner - Trustee, property
owner, and Boone Thomas, applicant, be and the same is hereby changed
from RSF Residential Single Family District with conditions to RSF
Residential Single Family District with amended conditions, and the
Subdivision Plat of Rivendell recorded as referenced above shall be
amended in this respect and no other, said property being described as
follows:
Beginning at an iron pin found on the northerly right of way line of
Item # 4BDate: August 24, 2020
Northern Trail, said point being 73.97’ from the intersection of Northern
Trail and Polar Lane; thence with a curve turning to the left with an arc
length of 50.49', with a radius of 325.00', a chord bearing of S41°16'05" W
50.44' to a point; thence with a curve turning to the right with an arc
length of 37.79', with a radius of 25.00', a chord bearing of S80°07'36" W
34.30' to a point; thence n 56°33'49" W a distance of 188.30' to an iron pin
found; thence W74°28'00"E a distance of 135.32' to an iron pin found;

containing 0.357 acres lying and being in the City of Salem, Virginia; and

Section 2. The following conditions voluntarily proffered shall apply in addition to
the regulations contained in Chapter 106 of The Code of the City of

1. All lots shall meet all zoning requirements including the minimum
road frontage requirements;
2. Sight distance requirements shall be met for the proposed
intersection;
3. Building requirements of no vinyl, only brick and stone
foundations, architectural shingles, paved driveways, and stone and
landscaped entranceway.
4. There is to be no access to Lots 7, 8, 9, and 11, and 1 through
Polar Lane.
All ordinances or parts of ordinances in conflict with the provisions of this ordinance be
and the same are hereby repealed.
This ordinance shall be in full force and effect ten (10) days after its final passage.

Abstract of Minutes of the June 25, 2007, Salem City Council meeting
A regular meeting of the Council of the City of Salem,
Virginia, was held in the Council Chambers, City Hall, 114 North
Broad Street, on June 25, 2007, at 7:30 p.m., there being
present the following members of said Council, to wit: Howard
C. Packett, Jane W. Johnson, John Christopher Clemens, and Byron
R. Foley (John C. Givens – absent); with Howard C. Packett,
Mayor, presiding; together with James E. Taliaferro, Assistant
City Manager and Clerk of Council; Melinda J. Payne, Director of
Planning and Development; Charles E. VanAllman, City Engineer;
and Stephen M. Yost, City Attorney; and the following business
was transacted:
Mayor Packett called the meeting to order at 7:30 p.m.

Mayor Packett reported that this date and time had been set
to hold a public hearing to consider the request of Frank C.
Young Heirs, property owners, and M & G LLC, contract purchaser,
for rezoning an approximate 9.28-acre parcel located on Polar
Lane (Tax Map #10-1-1) from AG Agricultural District to RSF
Residential Single Family District; and
WHEREAS, the Clerk of Council reported that notice of such
hearing had been published in the June 7 and 14, 2007, issues of
the Salem Times-Register, a newspaper published and having
general circulation in the City of Salem; and
WHEREAS, the Planning Commission at its regular meeting
held on June 13, 2007, recommended to the Council of the City of
Salem that the rezoning be approved; and
WHEREAS, staff noted the following: the subject property
consists of one parcel located off Polar Lane and is directly
south of Interstate 81; the property, approximately 9.28 acres,
is currently occupied by a barn and is zoned Agricultural; this
request is to rezone the property from AG to RSF; the contract
purchaser, M & G LLC, wishes to build an 11-lot residential
subdivision, with lots ranging from 13,000 sq. ft. to 115,000
sq. ft. (.29 ac to 2.65 ac); once subdivided, the lots will be
sold for the purpose of the buyers building custom homes;
restrictive covenants will be put into effect governing minimum
house sizes and building materials; the engineers also state the
developer will install and dedicate a new road to serve the
subdivision that will meet City of Salem Right of Way
requirements; the engineers state that the list of restrictive
covenants is under development and has not been included in the
information sent to staff; and
WHEREAS, Sean Horne of Balzer and Associates Inc., Roanoke,
representing the contract purchaser, appeared before Council to
explain the request; he stated that the proposed subdivision is
an 11-lot subdivision with a minimum lot size of 13,000 square
feet ranging up to approximately two and one-half acres; he
stated that the total density of the project is only about 1.18
units per acre; he further stated that access to the subdivision
is off Polar Lane and that all roads will be built according to
the City’s specifications; he stated that the minimum house size
is anticipated at 2,500 to 3,200 square feet with an average
value of $400,000 to $600,000; he stated that building
requirements will be set, which would include no vinyl, only
brick and stone foundations, architectural shingles, paved
driveways, stone and landscaped entranceway, etc.; Mr. Horne
stated that there were some questions about lot sizes, and road
frontage which have been addressed; he further stated the
following conditions have been proffered: 1.) all lots shall
meet the zoning requirements, including the minimum road
frontage requirements, and 2.) sight distance requirements shall
be met for the proposed intersection; he stated that since the
original letter was submitted, an item came up concerning access
to Polar Lane and the intent is that all access from the lots
would come off the new road and not from Polar Lane; he further
stated that the developer is willing to also proffer that all
residential access will be off of the new road; and
WHEREAS, Councilman Clemens discussed the conditions being
proffered and questioned if the developer would also be willing
to proffer the building requirements of no vinyl, but brick or
stone foundations, architectural shingles, paved driveways, and
stone or brick entranceways; and
WHEREAS, Mr. Horne stated that the developer is willing to
proffer the building requirements; and
WHEREAS, no other person(s) appeared related to the
request;
ON MOTION MADE BY COUNCILWOMAN JOHNSON, SECONDED BY
COUNCILMAN CLEMENS, AND DULY CARRIED, an ordinance entitled “AN
ORDINANCE TO AMEND SECTION 106-110, ARTICLE I, CHAPTER 106, OF
THE CODE OF THE CITY OF SALEM, VIRGINIA, RELATING TO
ESTABLISHING DISTRICT BOUNDARY LINES ON THE ZONING MAP OF THE
CITY OF SALEM, VIRGINIA,” with voluntarily proffered conditions
was duly passed on first reading with voluntarily proffered
conditions -- the roll call vote: all present - aye.

AN ORDINANCE TO AMEND SECTION 106-110, ARTICLE I, CHAPTER 106,
OF THE CODE OF THE CITY OF SALEM, VIRGINIA, RELATING TO ZONING
AND DIVIDING THE CITY INTO BUILDING DISTRICTS AND ESTABLISHING
DISTRICT BOUNDARY LINES ON THE ZONING MAP OF THE CITY OF SALEM,
VIRGINIA.
WHEREAS, Frank C. Young Heirs, property owners, and M. & G.
L.L.C., contract purchaser, have heretofore petitioned to have
an approximate 9.28-acre parcel located on Polar Lane (Tax Map #
10-1-1),rezoned from AG Agricultural District, to RSF
Residential Single Family District; and
WHEREAS, in said petition, M. & G. L.L.C., contract
purchaser, did voluntarily proffer written conditions in
addition to the regulations provided for in RSF Residential
Single Family District into which this property is requested to
be rezoned; and
WHEREAS, Council has reviewed the proposed conditions and
is of the opinion that the requested rezoning without the
proposed conditions would not be in the best interests of the
City and that the conditions proffered will more closely comply
with the intent of the Land Use Plan heretofore adopted; and
WHEREAS, Council has adopted the provisions of Chapter 320
of the 1978 Acts of the General Assembly of Virginia, Sections
15.2-2296 through 15.2-2302, relating to conditional zoning; and
WHEREAS, the Planning Commission at its regular meeting
held on June 13, 2007, did recommend to Council after holding a
public hearing that such rezoning be approved with the
voluntarily proffered conditions; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM,
VIRGINIA, that Section 106-110, Article I, Chapter 106, of The

AN ORDINANCE TO CONTINUE TEMPORARY CHANGES IN CERTAIN DEADLINES AND TO
MODIFY PUBLIC MEETING AND PUBLIC HEARING PRACTICES AND PROCEDURES TO
ADDRESS CONTINUITY OF OPERATIONS ASSOCIATED WITH PANDEMIC DISASTER.
WHEREAS, on March 12, 2020, Governor Ralph S. Northam issued Executive Order Fifty-One
declaring a state of emergency for the Commonwealth of Virginia arising from the novel Coronavirus
(COVID-19) pandemic; and
WHEREAS, Executive Order Fifty-One acknowledged the existence of a public health
emergency which constitutes a disaster as defined by Virginia Code § 44-146.16 arising from the
public health threat presented by a communicable disease anticipated to spread; and
WHEREAS, Executive Order Fifty-One ordered implementation of the Commonwealth of
Virginia Emergency Operations Plan, activation of the Virginia Emergency Operations Center to
provide assistance to local governments, and authorization for executive branch agencies to waive
“any state requirement or regulation” as appropriate; and
WHEREAS, on March 13, 2020, the President of the United States declared a national
emergency, beginning March 1, 2020, in response to the spread of COVID-19; and
WHEREAS, on March 11, 2020, the World Health Organization declared the COVID-19
outbreak a pandemic; and
WHEREAS, on March 23, 2020, the Council of the City of Salem, Virginia confirmed the
declaration of local emergency made by the local director of emergency management on March 17,
2020; and
WHEREAS, health officials at the Federal, State and Local level have repeatedly advised that
gatherings of people can spread the illness and prolong the disaster caused by the COVID-19
pandemic; and
WHEREAS, the usual and necessary operations of government, by law, often require large
gatherings of people in person, which would contradict the advice of the government and health
officials responsible for addressing the continued disaster caused by the COVID-19 pandemic; and
WHEREAS, the Council of the City of Salem, Virginia, wishes to follow the guidance of
government and health officials while providing for the continuity of City government and critical
local services during the State of Emergency and continued disaster caused by the COVID-19
pandemic; and
WHEREAS, Section 15.2-1413 of the Code of Virginia authorizes the Council to act to assure
continuity of government in the event of a disaster, notwithstanding any contrary provisions of law;
and
WHEREAS, the Council adopted an emergency Continuity Ordinance on March 27, 2020; and
WHEREAS, the Ordinance of March 27, 2020 provided that it would remain in full force and
effect for a period not to exceed six (6) months; and

WHEREAS, outbreaks of the virus have occurred in different areas of the United States, and
health experts warn of the possibility of a second wave of the pandemic during the fall and winter;
and
WHEREAS, health officials at the Federal, State and Local level continue to advise that large
gatherings of people can spread the illness and prolong the disaster caused by the COVID-19
pandemic; and
WHEREAS, the Council wishes to insure the continuity of City government during the
remainder of the COVID-19 pandemic; and
WHEREAS, the Council determines that the continuity of City government and provision of
critical local services require the adoption of this Ordinance.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, VIRGINIA:
1. That the Council, School Board, Planning Commission, Board of Zoning Appeals, Economic
Development Authority, Board of Equalization, or other City Boards, Commissions or
Authorities (collectively, the “Public Bodies”) may, at their election, conduct meetings and act
upon proposed agenda items for the duration of the Emergency, either under normal
procedures or by electronic means (to include, by way of example, meetings where a quorum
of the Public Body is assembled by electronic means but is not physically assembled) in
compliance with public notice, access, and other legal requirements governing the provision
of notice and the holding of public meetings. Notwithstanding the foregoing, the Public Body
may modify or dispense with those requirements to the extent necessary or practicable to
address the State of Emergency and Disaster caused by the COVID-19 pandemic.
2. If the Public Body conducts a public hearing during the Emergency, the public hearing may
be conducted using a procedure described in the notice provided in advance of the meeting
or by any other method specified by the Public Body at the meeting. The method of receiving
public comment should be reasonable under the circumstances of the meeting, the items to
be considered, and the state of the emergency in the City. Examples of methods could
include comments received by e-mail, by telephone, by web conferencing or virtual meeting
applications, or in person (so long as recommendations of public health officials are
observed). Public comments will be received by the Public Body before a vote on the public
hearing matter and will be made a part of the record of the meeting.
3. The City Manager is authorized to (i) modify, limit, or suspend City programs, functions, or
services as needed to ensure the effective continuity of government; (ii) restrict City staff and
the public from entering or congregating around City-owned buildings, facilities, and real
property as necessary to ensure the health, safety, and welfare of the public and staff; and
(iii) regulate the use of such buildings, facilities, and real property for the public health, safety,
and welfare. The City Manager is further authorized to take actions objectively reasonable
and necessary in the public health interest to alter schedules, provide programming, pay bills,
engage contractors, hire employees, and adjust administrative processes and procedures to
address the disaster, all in keeping with the U.S. Centers for Disease Control and Virginia
Department of Health guidance and directives, and consistent with state and local
declarations of emergency.
4. That this Ordinance will be in full force and effect on and after its passage as provided by law
and will remain in effect until the earlier of its repeal or the end of the Declaration of Local

Emergency by Resolution of the City Council. Upon repeal or expiration of this Ordinance, the
Public Bodies will resume operation in accordance with standard operating practices and
procedures.
Nothing in this Ordinance shall prohibit Public Entities from holding in-person public meetings
provided that public health and safety measures as well as social distancing are taken into
consideration.

SUMMARY OF INFORMATION:
The City receives highway maintenance funding each year and any unspent funds may be
carried forward to the subsequent fiscal year. An appropriation of $66,742 from carryover
funds is needed to cover the purchase of a hydroseeder and a crash attenuator trailer.
These pieces of equipment will only be used on eligible state road projects.

FISCAL IMPACT:
Highway maintenance funds may only be used for maintenance costs as determined by the
State. The equipment purchases fall within the guidelines of the highway maintenance
program.
STAFF RECOMMENDATION:
Staff recommends appropriating $66,742 of carryover funds to account 10-018-4001-
58001, Primary Roads – Machinery and Equipment.
